SLS 18RS-719 ORIGINAL 2018 Regular Session SENATE BILL NO. 524 BY SENATOR LONG WATER MANAGEMENT. Requires the Sabine River Authority to obtain approval of the Water Resources Commission prior to the sale of water outside the state. (8/1/18) 1 AN ACT 2 To amend and reenact R.S. 38:2325(A)(16)(d) and 3097.4(D)(7) and to enact R.S. 3 38:3097.4(D)(8), relative to the Sabine River Authority; to add certain requirements 4 prior to entering into any contracts to sell water; and to provide for related matters. 5 Be it enacted by the Legislature of Louisiana: 6 Section 1. R.S. 38:2325(A)(16)(d) and 3097.4(D)(7) are hereby amended and 7 reenacted and R.S. 38:3097.4(D)(8) is hereby enacted to read as follows: 8 §2325. Powers 9 A. Said authority shall have the power: 10 * * * 11 (16) * * * 12 (d) In addition, at least two-thirds of the governing authorities of the parishes 13 within the territorial jurisdiction of the authority shall concur before the authority can 14 enter into any contracts or other agreements which provide for the sale, utilization, 15 distribution, or consumption, outside of the boundaries of the state of Louisiana, of 16 the waters over which the authority has jurisdiction or control. The written concurrence of the Water Resources Commission shall 3 be required for any contracts and other agreements which provide for the sale, 4 utilization, distribution, or consumption, outside of the boundaries of the state 5 of Louisiana, of the waters over which the authority has jurisdiction or control. 6 * * * 7 §3097.4. The commission shall have the authority to do the following: 10 * * * 11 (7) Provide written concurrence to the Sabine River Authority prior to 12 the authority entering into any and all contracts and other agreements with any 13 person which provide for the sale, conservation, storage, utilization, 14 preservation, distribution, or consumption, outside of the boundaries of the 15 state of Louisiana, of the waters over which the authority has jurisdiction or 16 control. 17 (8) At their discretion, attend all public meetings called by the commissioner 18 pursuant to his power and duties in this Chapter. DIGEST SB 524 Original 2018 Regular Session Long Present law authorizes the Sabine River Authority (SRA) to enter into any and all contracts that provide for the sale, conservation, storage, utilization, preservation, distribution, or consumption, whether within or without the state of Louisiana, of the waters over which the SRA has jurisdiction or over which the SRA has legal control. Present law requires the written concurrence of the governor, the Senate Comm. on Natural Resources and the House Comm. on Natural Resources and Environment, and at least two-thirds of the parish governing authorities within the territorial jurisdiction of the SRA before it can enter into any contracts which provide for the sale, utilization, distribution, or consumption, outside of the boundaries of the state of Louisiana, of the waters over which the SRA has jurisdiction or control.
