(8/1/18) 1 AN ACT 2 To amend and reenact R.S. 14:402.1, relative to controlled dangerous substances in a 3 hospital; to provide for applicability to all hospitals; to provide for relevant statutory 4 reference; and to provide for related matters. 5 Be it enacted by the Legislature of Louisiana: 6 Section 1. R.S. 14:402.1 is hereby amended and reenacted to read as follows: 7 ยง402.1. Taking of contraband to state-owned hospitals unlawful; penalty 8 A. It shall be unlawful for any person to introduce or attempt to introduce 9 into or upon the grounds or buildings of any state owned and administered hospital 10 or related facility, except through regular channels as authorized by the administrator 11 of the hospital, any of the following articles which are hereby declared contraband 12 for the purposes of this Part Section, namely: Any intoxicating beverage or beverage 13 which causes or may cause an intoxicating effect; any narcotic or hypnotic or 14 exciting drug of whatever kind or nature including nasal inhalators of any variety, 15 sleeping pills or barbiturates of any variety that create or may create a hypnotic 16 effect if taken internally controlled dangerous substance that has not been 17 prescribed in accordance with the Uniform Controlled Dangerous Substances Page 1 of 2 Coding: Words which are struck through are deletions from existing law; words in boldface type and underscored are additions. DIGEST SB 76 Original 2018 Regular Session Boudreaux Present law prohibits taking certain contraband into state-owned and administered hospitals. Proposed law is applicable to all hospitals. Present law identifies one form of contraband prohibited in hospitals as narcotic or hypnotic drugs that create a hypnotic effect if taken internally. Proposed law modernizes this definition to include any controlled dangerous substance that has not been prescribed in accordance with the Uniform Controlled Dangerous Substances Law.
