SENATE BILL NO. 80

CORONERS.  Provides for the payment of expenses incurred in the disposition of paupers
arranged by coroners. (8/1/18)
1	AN ACT
2 To amend and reenact R.S. 13:5715(A)(2), relative to coroners; to provide relative to the
3 disposition of paupers; to provide for disposition expenses; and to provide for related
4 matters.
5 Be it enacted by the Legislature of Louisiana:
6 Section 1.  R.S. 13:5715(A)(2) is hereby amended and reenacted to read as follows: 
7 ยง5715. Delivery of body; disposition of paupers; anatomical gifts; kidney or eye
8	removal; limitation of liability
9	A.(1) *          *          *
10	(2) The coroner shall arrange for the disposition of paupers, preferably by a
11 Louisiana licensed funeral home. The disposition expenses shall not exceed the
12 actual cost of the service, and shall be paid by the parish or municipality in which the
13 death occurred coroner of the parish of the decedent's domicile, if located in
14 Louisiana, or by the coroner of the parish where the death occurred if the
15 decedent's domicile is not in Louisiana, who shall assume jurisdiction of the case
16 and accept the remains for future disposition pursuant to the law. However, such

1 treatment facility shall not be paid by the parish or municipality in which the death
2 occurred, but shall be paid by the state. The state or any municipality or parish
3 coroner may establish a maximum amount which it shall pay for individual
4 disposition expenses.

Present law provides that a coroner shall arrange for the disposition of paupers and the
disposition expenses shall not exceed the cost of the service.
Proposed law retains present law.
Present law provides that the disposition expenses for paupers shall be paid by the parish or
municipality in which the death occurred.
Proposed law provides that disposition expenses for paupers shall be paid by the coroner of
the parish of the decedent's domicile or, if the decedent's domicile is not in Louisiana, the
coroner of the parish where the death occurred.
Proposed law provides that if the decedent's domicile is not in Louisiana, the coroner of the
parish where the death occurred shall assume jurisdiction of the case and accept the remains
for future disposition.
Present law provides that disposition expenses of patients or residents of state-operated
health care or treatment facilities be paid by the state.
Proposed law retains present law.
Present law provides that the state or any municipality or parish may establish a maximum
amount to be paid for individual disposition expenses.
Proposed law provides that the state or any coroner may establish a maximum amount to be
paid for individual disposition expenses.
Effective August 1, 2018.
