NOTARIES.  Provides relative to notarial examinations by secretary of state. (gov sig)
1	AN ACT
2 To amend and reenact R.S. 35:191(C)(3), relative to notaries public; to provide relative to
3 written examinations and procedures; and to provide for related matters.
4 Be it enacted by the Legislature of Louisiana:
5 Section 1.  R.S. 35:191(C)(3) is hereby amended and reenacted to read as follows:
6 ยง191. Appointment; qualifications; examination

8	C. Each applicant, otherwise qualified, may be appointed a notary public in
9 and for a parish upon meeting all of the following conditions:

11	(3)(a) Taking and passing a written examination, as provided in R.S.
12 35:191.1, administered by the secretary of state.
13	(b)(i) The notary examination shall be given not less than twice per year on
14 the first Saturday of June and December. Should the scheduled Saturday be a state
15 holiday, then the next non-holiday Saturday shall be the test date days as
16 determined by the secretary of state.
17	(ii) To qualify to be examined, the candidate shall have satisfied all

1 requirements to be commissioned as a notary public in the parish, except for passing
2 the examination.
3	(iii) The qualified candidate shall be permitted to register for any notary
4 public examinations administered by the secretary of state within one year after the
5 date the secretary of state notifies the candidate of his approval to take the
6 examination. No further application fee shall be required during this period. The
7 required examination fee, however, shall be paid for each examination.
8	(c) The examination provided for in this Paragraph shall be dispensed with
9 if the applicant has been duly admitted to practice law in this state or holds a valid
10 notarial commission in this state.

12 Section 2.  This Act shall become effective upon signature by the governor or, if not
13 signed by the governor, upon expiration of the time for bills to become law without signature
14 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If
15 vetoed by the governor and subsequently approved by the legislature, this Act shall become
16 effective on the day following such approval.

Present law provides relative to notary examinations. Provides that the written examination
administered by the secretary of state shall be on the first Saturday of June and December.
Proposed law provides that the secretary of state can administer the notary examination more
than twice a year, and that all examination dates will be determined by the secretary of state.
Effective upon signature of governor or lapse of time for gubernatorial action.
