HOUSE BILL NO. 117

HIGHWAYS:  Authorizes golf carts to cross certain Louisiana highways within the town
of Church Point
1	AN ACT
2To enact R.S. 32:127.4, relative to highway right-of-way crossings; to authorize golf carts
3 to cross Louisiana Highway 95, Louisiana Highway 35, Louisiana Highway 1104,
4 and Louisiana Highway 178 in the town of Church Point; to establish requirements
5 for receipt of a utility terrain vehicle permit to cross certain highways in the town of
6 Church Point; to provide for the erection of signage reflecting such crossings; to
7 provide for exceptions; and to provide for related matters.
8	Notice of intention to introduce this Act has been published
9	as provided by Article III, Section 13 of the Constitution of
10	Louisiana.
11Be it enacted by the Legislature of Louisiana:
12 Section 1.  R.S. 32:127.4 is hereby enacted to read as follows: 
13 ยง127.4.  Golf carts; Church Point
14	A.  Notwithstanding any law to the contrary, upon final approval of the
15 Department of Transportation and Development, golf carts shall be authorized to
16 cross Louisiana Highway 95, Louisiana Highway 35, Louisiana Highway 1104, and
17 Louisiana Highway 178 on marked or designated paths or crossings for such vehicles
18 within the town limits of Church Point between sunrise and sunset.
19	B.  A copy of the applicant's valid driver's license and liability insurance, a
20 signed liability waiver, and a seventy-five dollar permit fee shall be submitted

1 annually with a utility terrain vehicle permit application as a prerequisite for
2 operating a golf cart when crossing Louisiana Highway 95, Louisiana Highway 35,
3 Louisiana Highway 1104, and Louisiana Highway 178 in the town of Church Point.
4	C.  Signs designating paths or crossings for golf carts shall be posted by the
5 Department of Transportation and Development or by the town of Church Point with
6 prior approval from the Department of Transportation and Development.
7	D.  The Department of Transportation and Development, with the
8 consultation and advice of the governing authority of the town of Church Point, shall
9 formulate guidelines to determine the safest and most convenient location for golf
10 cart crossings and for signage designating such crossings.
11	E.  For the purposes of this Section, the provisions of R.S. 32:53(D), 235(C),
12 261, and Chapter 5 of this Title shall not apply, and the provisions relative to
13 equipment of vehicles referenced in Part V of Chapter 1 of this Title shall not apply
14 to golf carts.

Proposed law authorizes golf carts to cross La. Hwy. 95, La. Hwy. 35, La. Hwy. 1104, and
La. Hwy. 178 on marked or designated paths or crossings within the town limits of Church
Point between sunrise and sunset.
Proposed law requires that a valid driver's license, proof of liability insurance, a signed
liability waiver, and a $75 permit fee, accompanied by a utility terrain vehicle permit
application, be submitted and approved annually prior to operating a golf cart while crossing
La. Hwy. 95, La. Hwy. 35, La. Hwy. 1104, or La. Hwy. 178 in the town of Church Point.
Proposed law requires that signs designating paths or crossings for golf carts be posted by
the Dept. of Transportation and Development (DOTD) or by the town of Church Point with
prior approval from the DOTD.
Proposed law requires that the DOTD, with the consultation and advice of the governing
authority of the town of Church Point, formulate guidelines to determine the placement of
the golf cart crossings and signage reflecting such crossings.

Proposed law excepts the provisions of proposed law from certain requirements contained
in present law pertaining to inspection stickers, placement of traffic control signs,
prohibitions against use of a road, and provisions related to the motor vehicle safety
responsibility law.
