LAW ENFORCE/OFFICERS:  Provides relative to motorcyclist profiling training for peace
officers
1	AN ACT
2To amend and reenact R.S. 40:2405.8(G) and to enact R.S. 40:2405.8(H), relative to peace
3 officer training requirements; to provide for the creation of a motorcyclist profiling
4 awareness training program; to provide for definitions; and to provide for related
5 matters.
6Be it enacted by the Legislature of Louisiana:
7 Section 1.  R.S. 40:2405.8(G) is hereby amended and reenacted and R.S.
840:2405.8(H) is hereby enacted to read as follows: 
9 ยง2405.8.  Additional peace officer training requirements

11	G.(1)  The council shall include motorcyclist profiling awareness training in
12 the current bias recognition policing curriculum.  The training shall consist of at least
13 one-half hour of classroom or internet instruction, or a combination of classroom and
14 internet instruction.  This training shall address issues related to motorcyclist
15 profiling and shall be provided to peace officers as defined in R.S. 40:2402(3)(a).
16	(2)  For purposes of this Subsection, "motorcyclist profiling" shall mean the
17 arbitrary use of the fact that an individual rides a motorcycle or wears motorcycle-
18 related clothing or paraphernalia as a factor in deciding to stop, question, take

1 enforcement action, arrest, or search the individual or his motorcycle or motor
2 vehicle.
3	G.H.(1)  The council shall promulgate rules and regulations in accordance
4 with the Administrative Procedure Act, subject to the oversight of the House
5 Committee on the Administration of Criminal Justice and the Senate Committee on
6 Judiciary B, for the implementation of a homicide investigator training program no
7 later than July 1, 2016.
8	(2)(a)  The council shall promulgate rules and regulations in accordance with
9 the Administrative Procedure Act, subject to the oversight of the House Committee
10 on the Administration of Criminal Justice and the Senate Committee on Judiciary B,
11 for the implementation of a sexual assault awareness training program as provided
12 in R.S. 17:1805(H) no later than October 1, 2015.
13	(b)  The council shall promulgate rules and regulations in accordance with
14 the Administrative Procedure Act, subject to the oversight of the House Committee
15 on the Administration of Criminal Justice and the Senate Committee on Judiciary B,
16 for the implementation of a sexual assault awareness training program for peace
17 officers as defined in R.S. 40:2402(3)(a) as provided in Paragraph (C)(3) of this
18 Section no later than January 1, 2017.
19	(3)(a)  The council shall promulgate rules in accordance with the
20 Administrative Procedure Act for implementation of the following training programs
21 for peace officers as provided in Subsections E and F of this Section:
22	(i)  Domestic violence awareness training.
23	(ii)  Communication with deaf or hard of hearing individuals.
24	(b)  The council shall create and maintain a list of peace officers who have
25 successfully completed the domestic violence awareness training and the training on
26 communication with deaf or hard of hearing individuals.

Proposed law requires the Council on Peace Officer Standards and Training to add
motorcyclist profiling awareness training to the current bias recognition policing curriculum. 
Proposed law defines "motorcyclist profiling" for purposes of this training.
(Amends R.S. 40:2405.8(G); Adds R.S. 40:2405.8(H))

bill:
1. Make technical changes.
