BANKS/BANKING: Provides for the disclosure of certain financial records to law
enforcement pursuant to a search warrant
1 AN ACT
2To amend and reenact R.S. 6:333(F)(11), relative to the disclosures by a bank or any
3 affiliate; to provide for financial records obtained pursuant to search warrants; and
4 to provide for related matters.
5Be it enacted by the Legislature of Louisiana:
6 Section 1. R.S. 6:333(F)(11) is hereby amended and reenacted to read as follows:
7 ยง333. Disclosure of financial records; reimbursement of costs

9 F. The following disclosures by a bank or any affiliate are hereby
10 specifically authorized and, except as otherwise provided in this Subsection, nothing
11 in this Section shall prohibit, restrict, or otherwise apply to:

13 (11) The disclosure by a bank or any affiliate of financial records in
14 situations governed by, pursuant to, and in accordance with the provisions of 12
15 U.S.C. 3401 et seq., or 15 U.S.C. 6801 et seq., or pursuant to a search warrant issued
16 in accordance with Title IV of the Code of Criminal Procedure.

Abstract: Authorizes a bank or affiliate to disclose financial records obtained pursuant to
a search warrant.
Present law allows a bank or any affiliate to disclose financial records obtained pursuant to
certain provisions of present law. Proposed law retains present law and adds financial
records obtained pursuant to a search warrant issued in accordance with present law.
