[R.S. 1:13(B) and 24:177(E)] HB 146 Engrossed 2019 Regular Session Crews Abstract: Requires certain geographic information to be made available in a certain format. Present law (R.S. 44:1 et seq.—Public Records Law) provides for access and retention of public records. Establishes a framework for the ready availability of public records to requesting persons, and specifically provides that it is the duty of the custodian of the public records for a public entity or agency to provide copies to persons so requesting. Proposed law retains present law. Additionally requires, subject to present law (R.S. 44:1(B) and 3.2), any public record that consists of geographic information system data that is made available to the public by the Dept. of Transportation and Development on the internet to additionally be made available to the public by the department on the internet in a format for expressing geographic annotation and visualization in two-dimensional or three-dimensional representations using applications that are available to the public without charge, such as KML. Proposed law provides that it applies only to files created or updated on or after July 1, 2020. Effective July 1, 2020. (Adds R.S. 44:42) Summary of Amendments Adopted by House The Committee Amendments Proposed by House Committee on House and Governmental Affairs to the original bill: 1. Limit proposed law to data made available by the Dept. of Transportation and Development. 2. Specify that proposed law is subject to present law (R.S. 44:1(B) and 3.2). 3. Change the effective date of proposed law from August 1, 2020, to July 1, 2020. 4. Provide that proposed law applies only to files created or updated on or after July 1, 2020.
