HOUSE BILL NO. 196

1 AN ACT
2 To amend and reenact R.S. 37:21(A)(5) and (B)(1) and (2) and to enact R.S. 37:21(C),
3 relative to professions and occupations; to provide for exceptions to time limitations
4 after which disciplinary proceedings shall not be instituted by professional or
5 occupational boards and commissions; to provide with respect to complaint
6 notification and hearing time limitations; to provide with respect to the Louisiana
7 Professional Engineering and Land Surveying Board; to provide with respect to the
8 State Board of Architectural Examiners; to provide certain exceptions; and to
9 provide for related matters.
10 Be it enacted by the Legislature of Louisiana:
11 Section 1. R.S. 37:21(A)(5) and (B)(1) and (2) are hereby amended and reenacted
12 and R.S. 37:21(C) is hereby enacted to read as follows:
13 ยง21. Limitations on disciplinary proceedings by professional or occupational boards
14 and commissions
15 A. Unless a special law is applicable, no proceeding of any kind may be
16 initiated by a professional or occupational board or commission as follows:

18 (5) In all cases where a complaint is filed with a professional or occupational
19 board or commission, the board or commission shall notify the licensee who is
20 specifically named in the complaint as the subject of the complaint in writing of the
21 complaint within six months after the filing of the complaint or be barred from
22 further action thereon. The board or commission shall hold any required hearing
23 within six months after the notice of the hearing, but this period may be interrupted
24 by the filing of procedural motions.

1 B. The provisions of this Section shall not apply to the following:
2 (1) A physician licensed to practice medicine. The Louisiana State Board of
3 Medical Examiners.
4 (2) A dentist, dental hygienist, or any person practicing dentistry or dental
5 hygiene with or without a license. The Louisiana State Board of Dentistry.

7 C. The provisions of Paragraph (A)(5) of this Section with respect to the
8 time of hearing only shall not apply to the following:
9 (1) The Louisiana Professional Engineering and Land Surveying Board.
10 (2) The State Board of Architectural Examiners.
