of Northwest Louisiana.................................90 Table of Contents • vii HLS 19RS-639 REENGROSSED 2019 Regular Session HOUSE BILL NO. 2 BY REPRESENTATIVE ABRAMSON CAPITAL OUTLAY: Provides for the comprehensive Capital Outlay budget 1 AN ACT 2To provide with respect to the capital outlay budget and the capital outlay program for state 3 government, state institutions, and other public entities; to provide for the designation 4 of projects and improvements; to provide for the financing thereof making 5 appropriations from certain sources; and to provide for related matters. 6Be it enacted by the Legislature of Louisiana: 7 Section 1. The following sums or so much thereof as may be necessary are hereby 8appropriated out of any monies in the state treasury from the sources specified, from federal 9funds and self-generated revenues belonging to the state of Louisiana and/or collected by 10boards, commissions, departments, and agencies thereof, all for making capital outlay and 11for the purposes and in the amounts specified herein for the Fiscal Year commencing July 121, 2019, and ending June 30, 2020, subject to the conditions thereafter provided: 13 A project with funding payable from General Obligation Bonds Priority 1 indicates that 14the funding for the project includes the reauthorization of funding which was previously 15granted as a line of credit by the State Bond Commission in Fiscal Year 2018-2019. As used 16in this Section, the term "general obligation bonds" means state general obligation bonds or 17other evidences of indebtedness payable from the Bond Security and Redemption Fund. The 18amount set forth in this Section opposite each project, or so much thereof as may be 19necessary, is hereby appropriated and payable from the source of funding indicated; 20provided, however, amounts appropriated and payable from federal funds may be Page 1 of 116 HLS 19RS-639 REENGROSSED HB NO. 2 1encumbered or expended only to the extent such amounts shall have been committed or 2received. Pursuant to the provisions of R.S. 39:82, funds for planning, acquisition, 3construction, and major repair projects appropriated by this Act may be retained until 4completion of the project, even if no bona fide liability exists on the last day of the fiscal 5year. 6 This Act shall constitute the comprehensive state capital outlay budget for the 2019-2020 7Fiscal Year. Projects set forth which are payable from the proceeds available from the sale 8of general obligation bonds shall have the priorities as indicated. The Request for Line of 9Credit form used by the attorney general and Bond Counsel in evaluating Louisiana 10Constitutional, Internal Revenue Code, and applicable income tax regulations shall be filed 11with the commissioner of administration, State Bond Commission, and state attorney 12general. No general obligation bond cash lines of credit shall be granted to fund any lower 13priority project prior to the granting of general obligation bond cash lines of credit to fund 14all higher priority projects (the "general rule"), except as hereinafter provided. This 15prohibition against funding a lower priority project shall not apply upon a showing of an 16impossibility or impracticality either to proceed with all unfunded higher priority projects 17or to proceed with the funding of such projects or any part thereof through the issuance of 18general obligation bonds for any reason. Such showing shall be stated in reasonable detail 19in a certificate or certificates signed by the state agency responsible for administering the 20funding, and filed with the commissioner of administration and the State Bond Commission 21(hereinafter referred to as "the Commission"). Upon a determination by the Commission 22that proceeding with such a project or the funding thereof through the issuance of general 23obligation bonds is impractical or impossible, the Commission may then proceed with the 24sale of general obligation bonds or the granting of cash lines of credit without regard to the 25priority of the unfunded projects determined to be impossible or impractical. 26 Upon recommendation by the state agency responsible for administering the funding, if 27it is determined at any time that proceeding with the project or with the funding thereof is 28no longer impossible or impractical, the State Bond Commission may rescind the certificate 29of impossibility or impracticality and may proceed with the project or with the issuance of 30general obligation bonds or the granting of cash lines of credit to fund the project. Page 2 of 116 HLS 19RS-639 REENGROSSED HB NO. 2 1Alternatively, the Interim Emergency Board (hereinafter referred to as "the Board"), upon 2reviewing certificates as described above and determining that proceeding with such project 3or the funding thereof through the issuance of general obligation bonds is impossible or 4impractical, may designate a lower priority for such project. The Board's determination and 5lower priority designation shall be submitted to the members of the legislature for their 6approval in accordance with the provisions of Chapter 3-B of Subtitle I of Title 39 of the 7Louisiana Revised Statutes of 1950. In accordance with the provisions of Chapter 3-B of 8Subtitle I of Title 39 of the Louisiana Revised Statutes of 1950, whenever at the written 9request of the appropriate legislators and agency, the Board determines that an adjustment 10to a project description originally set forth in such capital budget adopted by the legislature 11for a current fiscal year is necessary to correct a mistake in a project description, clarify a 12description, change the scope of a description, or make any other adjustment the Board 13deems necessary to implement the purpose of the project, such adjustment shall become 14effective only upon the approval by majority vote of the elected members of each house of 15the legislature in the manner provided for in Chapter 3-B of Subtitle I of Title 39 of the 16Louisiana Revised Statutes of 1950. 17 If such approval is granted, notification by the chair or secretary of the Board of the 18results of the balloting shall be transmitted to the State Bond Commission, which may then 19proceed with the sale of general obligation bonds or the granting of cash lines of credit for 20each change approved upon request of the commissioner of administration in accordance 21with the general rule. 22 With respect to Priorities 1 through 5, a lower priority project may be moved to a higher 23priority only upon a showing of an emergency or other cause not reasonably anticipated by 24the legislature, which shall be stated in reasonable detail in a certificate signed by the head 25of the appropriate department, political subdivision, or agency and filed with the 26commissioner of administration and the Board. Upon a determination by the Board that such 27project should be moved to a higher priority because of an emergency or other cause not 28reasonably anticipated by the legislature, the Board shall designate a higher priority to the 29project. The matter then shall be submitted to and be subject to the same approval by the 30members of the legislature in the manner previously indicated in this Section. If such Page 3 of 116 HLS 19RS-639 REENGROSSED HB NO. 2 1approval is granted, notification by the chair or secretary of the board of the change of 2priority shall be transmitted to the State Bond Commission, which then upon request of the 3commissioner of administration, may proceed with the sale of general obligation bonds or 4the granting of cash lines of credit in accordance with the general rule. As to projects within 5a priority, the State Bond Commission acting on requests submitted by the commissioner of 6administration shall determine when such project, or phases thereof, shall be funded. In 7making such determination, the State Bond Commission shall consider the amount of 8proceeds of general obligation bonds to be made available in light of money and capital 9market conditions; the expenditure requirements of the project; the time required for 10architectural plans and drawings, public bidding, and site acquisition and preparation; 11availability of receipt of federal monies; litigation affecting the undertaking or completion 12of a project; federal tax laws and regulations regarding the sale of municipal bonds; and 13other items of a similar nature bearing upon the possibility or the necessity to commence a 14project or any particular phase thereof. 15 Any other provision of this Act to the contrary notwithstanding, projects described in 16Priority 5 of this Act shall not be moved to a higher priority except upon one of the 17following conditions: (1) Funding is necessary to complete or additionally fund a project 18located elsewhere in the Capital Outlay Act. Determination of such condition shall be made 19by the head of the appropriate department or agency by means of a certificate to that effect 20filed with the Interim Emergency Board, who shall, by mail ballot, request approval of such 21change and if approved by a majority of each house of the legislature it shall be funded, or 22(2) unless required by an emergency or other cause not reasonably anticipated by the 23legislature, to be in accordance with procedures set forth in this Section. However, the State 24Bond Commission may authorize a non-cash line of credit for any project in Priority 5 which 25represents that portion of construction contracts which were let during a previous fiscal year, 26or construction contracts which will be let during the current fiscal year, but which will not 27require cash expenditures during the year. Such non-cash lines of credit, when combined 28with previously sold bonds or with higher priority bonds or lines of credit, or with funds 29appropriated from other sources, will provide sufficient appropriated funds to award Page 4 of 116 HLS 19RS-639 REENGROSSED HB NO. 2 1equipment or construction contracts. Contracts shall not be awarded without approval of the 2division of administration. 3 Upon approval by the State Bond Commission, and subject to compliance with its 4policies and procedures and the procedures set forth herein, a line of credit providing for the 5use of funds in anticipation of the sale of general obligation bonds may be granted to the 6appropriate administering agency or department from the Comprehensive Capital Outlay 7Escrow Account, or if there is not a sufficient amount available in such account, from other 8available state cash in the state treasury, for capital improvement projects for which bond 9proceeds are appropriated by a current capital budget, prior to the actual issuance of bonds 10for such projects, unless the attorney general advises that an impediment exists to the valid 11issuance of the bonds on the date such line of credit is granted. 12 All bonds that are to be repaid, in whole or in part, by revenues generated by the project 13shall be designated as "Reimbursement Bonds". The State Bond Commission shall enter 14into such agreements as are necessary to provide that the agency or subdivision, whose 15project is reimbursable, shall pay the bond debt costs into the Bond Security and Redemption 16Fund. The expenditure of funds appropriated in this Act, except 25appropriations made to nonprofit economic development corporations, shall be in conformity 26to all existing statutes relative to public bidding, contractual review, and R.S. 39:101 through 27128 and any other statutes affecting the capital outlay program for state government, state 28institutions, and political entities. No contract shall be awarded for any project prior to the 29granting of a line of credit or the sale of bonds by the State Bond Commission, determination 30by the state treasurer that cash funding is available in the Comprehensive Capital Outlay 31Escrow Account for the project, or delivery of revenue bonds whose issuance is authorized 32in Section 1 of this Act. 33 Section 3. Payment for projects specified in this Act must be made by warrant 34submitted to the division of administration, Department of Transportation and Development, 35the state treasurer or other administering agency as provided in Section 8, whichever is 36appropriate, only to the extent of funds required for immediate payment. Copies of invoices 37or other supporting documentation shall be submitted with warrants. In the event that any Page 90 of 116 HLS 19RS-639 REENGROSSED HB NO. 2 1equipment included in this Act, is procured pursuant to the provisions of the State Lease- 2Purchase Act, R.S. 39:1761 et seq., the amounts included in this Act for each such piece of 3equipment shall not be appropriated. The provisions of R.S. 39:1771 which require 4equipment to be leased under the State Lease-Purchase Act to be included in the executive 5budget and approved by the legislature through inclusion in the General Appropriation Act 6shall be considered waived upon the inclusion of such equipment in this Act. Projects 7contained in this Act may, at the direction of the division of administration and with the 8approval of the State Bond Commission, alternatively be funded through financing programs 9heretofore or hereafter provided by a public trust and public corporation duly organized 10pursuant to R.S. 9:2341 et seq., having for its beneficiary the state and the Louisiana Local 11Government Environmental Facilities and Community Development Authority, pursuant to 12R.S. 33:4548.1 et seq. 13 Section 4. If at any time during the Fiscal Year 2019-2020, the governor should 14find, or the Joint Legislative Committee on the Budget or the commissioner of 15administration should report to the governor, that the receipts of the treasury are falling short 16or appear likely to fall short of the revenue estimates for the fiscal year and that a cash 17deficit is likely to be incurred, the governor shall take such steps as deemed necessary to 18prevent the occurrence of a cash deficit. In the event that a capital outlay project funded in 19this Act falls under an agency which is abolished or for which funds are not appropriated in 20the 2019-2020 General Appropriation Act, then the funds appropriated in this Act for such 21capital outlay projects shall not be expended unless deemed necessary by the governor to 22protect life or property. In the event that legislation is enacted which transfers facilities or 23programs for which projects are funded in this Act, on behalf of one agency, institution, 24department, or management board to another agency, institution, department, or management 25board, then the projects in this Act shall be deemed transferred also. 26 Section 5. All monies appropriated by this Act and any applicable funds of a 27prior capital outlay budget act adopted by the legislature shall be deposited by the state 28treasurer in the Comprehensive Capital Outlay Escrow Account, established by this Section, 29in the state treasury. In accordance with R.S. 36:764, no later than sixty days following the 30end of each quarter, the state treasurer shall report to the Joint Legislative Committee on the Page 91 of 116 HLS 19RS-639 REENGROSSED HB NO. 2 1Budget and the commissioner of administration, all funds contained in the Miscellaneous 2Fund of the Comprehensive Capital Outlay Escrow Account. Notwithstanding any 3provisions contained herein or other law to the contrary, any original issue premium or 4accrued interest proceeds received pursuant to the sale of general obligation bonds shall 5remain on deposit to the credit of the Bond Security and Redemption Fund until such time 6as they may be utilized in accordance with U.S. Department of the Treasury Regulations 7promulgated pursuant to the Internal Revenue Code of 1986. All such monies shall be 8administered according to the particular act pertaining to the fiscal year in which such 9monies were appropriated. If it is determined by the director of the office of facility 10planning and control, division of administration, that the funds appropriated by this Act or 11any prior capital outlay budget act are not sufficient to complete the projects contained in 12any capital outlay budget act, through unavoidable deficiencies in appropriation, including 13administrative and legal requirements, the commissioner of administration, subject to 14approval of the Joint Legislative Committee on the Budget, may direct the use of interest 15earned from the investment of general obligation bond or note proceeds in the 16Comprehensive Capital Outlay Escrow Account, not to exceed an aggregate of five million 17dollars in any one fiscal year, for the purpose of completing the projects contained in any 18capital outlay budget act and such money shall be deemed appropriated in specific amounts 19necessary for such purpose. All appropriations in this Act which are made as additions to 20funds for previously authorized projects shall be included, for accounting purposes, in the 21account of the previously authorized projects. If it is determined by the director of the office 22of facility planning and control, division of administration, that it is cost effective and 23practical to combine individual appropriations, the commissioner of administration, subject 24to the approval of the Joint Legislative Committee on the Budget, may direct that two or 25more appropriations or parts thereof may be combined into a single project for accounting 26and audit purposes. The commissioner of administration may direct that funding in the 27various statewide and/or multiple parish projects for improvements for state facilities may 28be transferred to any project, in this Act or any previous Capital Outlay Act, which require 29supplemental funding for improvements for state facilities which qualify for funding through 30the various statewide and/or multiple parish projects for improvements for state facilities. Page 92 of 116 HLS 19RS-639 REENGROSSED HB NO. 2 1The office of facility planning and control, division of administration is authorized to receive 2settlements and vendor rebates not in excess of $50,000 unless approved by the Joint 3Legislative Committee on the Budget, and to add those receipts to the funding for projects 4in this Act or any previous Capital Outlay Act for which project funds are received. The 5office of facility planning and control, division of administration is authorized to receive 6insurance payments and are hereby authorized to immediately repair facilities that suffer 7insurance losses without those projects being included in the Act and shall report to the Joint 8Legislative Committee on the Budget any expenditures from insurance funds received 9pursuant to this section. A portion, as determined by the commissioner of administration and 10not to exceed one percent (1%), of the funding for projects which qualify for the Percent for 11Art Program and not to exceed $450,000 for an individual, qualifying project, may be 12transferred from the qualifying project budgets, to the Department of Culture, Recreation and 13Tourism for costs of acquiring art and administering the program. For all Percent for Art 14Program projects in this or any previous capital outlay, up to ten percent (10%) of the 15aforementioned one percent (1%) may be used for the costs of administering the projects. 16 Section 6. Prior to March 1, 2020, the commissioner of administration shall 17submit to the Joint Legislative Committee on Capital Outlay a list of projects that are 18completed and the cash balances remaining in each project. 19 Section 7. The commissioner of administration, with the approval of the Joint 20Legislative Committee on the Budget, is authorized to supplement or substitute the 21appropriations specified in this or previous capital outlay acts with any federal or other funds 22which are or may become available and such funds shall be deemed appropriated in specific 23amounts necessary for the purposes of this Act. Any funds received by the State Bond 24Commission as a result of a prepayment of reimbursement contracts as authorized by law 25and the policy and procedure for reimbursement contracts of the Department of Treasury, 26office of State Bond Commission, shall be deposited as set forth in such policy and 27procedure and shall be deemed available and appropriated in specific amounts necessary for 28the purposes of this Act pursuant to the procedure set forth in this section. 29 Section 8A. All of the funds herein appropriated, except for appropriations made 30to the Department of Military Affairs, the Legislature, the Louisiana Stadium and Exposition Page 93 of 116 HLS 19RS-639 REENGROSSED HB NO. 2 1District, the Department of Economic Development, the Coastal Protection and Restoration 2Authority, the Division of Administration for Supplemental State Funds for Local 3Government Assistance Program, the Division of Administration for the Community Water 4Enrichment Program or the Department of Transportation and Development, shall be 5considered as having been appropriated directly to the Office of Facility Planning and 6Control, Division of Administration, and all projects herein authorized and funded shall be 7subject to the provisions of R.S. 39:101 through 128. All cooperative endeavor agreements 8for non-state entities shall be prepared by the office of facility planning and control and the 9commissioner of administration is hereby authorized and directed to effectuate any necessary 10transfer of funds from the Department of Justice to the office of facility planning and control 11in order to accomplish this purpose. 12 (1) Notwithstanding anything contained in this act to the contrary or any other 13provision of law, the appropriations made for the Louisiana Stadium and Exposition District 14shall be appropriated directly to the Louisiana Stadium and Exposition District, and are 15public purposes pursuant to the provisions of Article VII, Section 14 of the Constitution of 16Louisiana primarily for economic development, including the generation of tax revenue, 17creation of jobs, and the generation of tourism, and may be used to reimburse any 18expenditure made prior to the granting of a line of credit or the sale of bonds by the State 19Bond Commission, determination by the State Treasurer that cash funding has been 20deposited in the Comprehensive Capital Outlay Escrow Account for the project. 21 (2) Further, with respect to appropriations to the Louisiana Stadium and 22Exposition District for the TPC Louisiana, Planning and Construction project, the Louisiana 23Stadium and Exposition District shall be permitted to use alternative competitive 24procurement and delivery methods for the award of any contracts to be funded through such 25appropriation. 26 (3) The Louisiana Stadium and Exposition District shall have the authority to 27directly appoint a design professional from a list of a minimum of three architectural firms 28or joint ventures with professional sports facility design experience acceptable to the 29Commissioner of Administration and shall be exempt from other state requirements for 30selection of designers. The design professional fee shall be in accordance with state Page 94 of 116 HLS 19RS-639 REENGROSSED HB NO. 2 1guidelines administered by the Office of Facility Planning and Control, Division of 2Administration. 3 Section 8B.(1)(a) All of the funds appropriated in the Capital Outlay Act under 4the name of non-state entities shall be administered by the Office of Facility Planning and 5Control, Division of Administration, under cooperative endeavor agreements. Cooperative 6endeavor agreements entered into pursuant to this Act, and approved by the Commissioner 7of Administration or his designee, or the Secretary of the Department of Transportation and 8Development for projects appropriated to or administered by the Department of 9Transportation and Development, shall not be required to be submitted to the Division of 10Administration, Office of Contractual Review. 11 (b) Further, for all projects in the Capital Outlay Act or a previous Capital 12Outlay Act which are appropriated to the Office of Facility Planning and Control, Division 13of Administration, including those administered by cooperative endeavor agreements, up to 14six percent of each line-item may be used for costs of administering the projects. 15 (c) For all projects in Capital Outlay Act or a previous Capital Outlay Act 16appropriated to the Department of Transportation and Development, up to six percent of 17each line-item may be used for costs of administering the projects, or for field 18engineering/construction supervision. 19 (2) Notwithstanding anything in this Act, or a previous Capital Outlay Act, the 20Office of Facility Planning and Control may enter into a cooperative endeavor agreement 21with the Archdiocese of New Orleans and Jefferson Parish for the Preservation and 22Restoration of Historic Structure for Hope Haven/Madonna Manor Campus, Planning and 23Construction project. 24 (3) Notwithstanding anything in this Act, or a previous Capital Outlay Act, the 25Office of Facility Planning and Control may enter into a cooperative endeavor agreement 26with Terrebonne Parish Recreation Districts Two and Three and Terrebonne Parish for the 27Terrebonne Sports Complex Phase I, Infrastructure Improvements, Acquisition, Planning 28and Construction project. 29 Section 8C. Line-item general obligation bond projects appropriated to the 30Department of Transportation and Development in the Capital Outlay Act or a previous Page 95 of 116 HLS 19RS-639 REENGROSSED HB NO. 2 1Capital Outlay Act shall be authorized to draw Transportation Trust Funds from the 2Highway Program appropriation, for supplemental funding on overruns in excess of the 3original estimated project cost as determined by the Department of Transportation and 4Development, provided however that said projects are in the state or federal highway system 5and in the priority program, and the overrun is less than $50,000. Any such overrun of 6$50,000 or more must be approved by the Joint Legislative Committee on the Budget. 7 Section 8D. All ports, levee districts and other non-state entities must have a 8fully executed cooperative endeavor agreement, from the Office of Facility Planning and 9Control, Department of Transportation and Development, or the State Treasurer, whichever 10is appropriate, before entering into any contracts which obligate state funding and must 11follow all laws pertaining to public bidding. If a port, levee district or other non-state entity 12enters into a contract prior to receipt of funding, or prior to execution of a cooperative 13endeavor agreement, then payments under such contracts are prohibited from capital outlay 14appropriations, and are the sole responsibility of the port, levee district, or other non-state 15entity. 16 Section 8E. Pursuant to R.S. 39:122(B)(2), funds to be reimbursed by the state 17which a non-state entity attempts to obligate prior to the receipt of funding shall not be 18eligible for reimbursement or payment by the state; however, 19 (1) Notwithstanding anything in this Act or the Capital Outlay Act to the 20contrary, contracts may be entered into for the City of New Orleans, Eastern New Orleans 21Hospital and Medical Office Building, Real Estate Acquisition, Planning, Design, 22Construction, Renovation and Equipment project prior to receipt of funding and prior to 23execution of the cooperative endeavor agreement. 24 (2) Notwithstanding anything contained in this Act, or the Capital Outlay Act, 25or any other capital outlay act, contracts may be entered into for the Port of South Louisiana, 26Globalplex Rail Siding; Globalplex Terminal Building #71 Upgrade, Planning and 27Construction and/or Administration Building (also known as the Business Development 28Center) projects prior to receipt of funding and prior to execution of a cooperative endeavor 29agreement. Page 96 of 116 HLS 19RS-639 REENGROSSED HB NO. 2 1 (3) Notwithstanding anything in this Act or the Capital Outlay Act to the 2contrary or any other provision of law, contracts may be entered into for the Greater Baton 3Rouge Port Commission Inland Rivers Marine Terminal Dock and Access Roadway 4Construction Project, Planning and Construction Project prior to receipt of funding and prior 5to the execution of a cooperative endeavor agreement. 6 (4) Notwithstanding anything in this Act or the Capital Outlay Act to the 7contrary or any other provision of law, contracts may be entered into for the Outpatient 8Clinics in Rapides Parish, Planning and Construction project for the Division of 9Administration prior to the execution of a cooperative endeavor agreement. 10 (5) Notwithstanding anything in this Act or the Capital Outlay Act to the 11contrary or any other provision of law, contracts may be entered into for the Mississippi 12River Levee Raising, Arkansas to Old River project prior to receipt of funding, and the State 13is authorized to financially participate in obligations created by such contracts. 14 (6) Notwithstanding anything in this Act or the Capital Outlay Act to the 15contrary or any other provision of law, contracts may be entered into for the Old McKinley 16High School Community Center on Thomas Delpit Drive in the City of Baton Rouge, 17Kitchen and Building Renovations, Repairs and Upgrades Including Elevator Repair Project 18prior to receipt of funding and prior to the execution of a cooperative endeavor agreement, 19and unless the Commissioner of Administration is advised by bond counsel to the state that 20such may violate federal tax law, the appropriation may be used to reimburse any 21expenditure made prior to the granting of a line of credit or the sale of bonds by the State 22Bond Commission. 23 (7) Notwithstanding anything contained in this Capital Outlay Act, or any 24previous Capital Outlay Act to the contrary, or any other provision of law, contracts may be 25entered into for the Broussard, Reconstruct South Bernard Road from La. Hwy. 182 to US 26Highway 90, Planning and Construction in Lafayette Parish project, prior to execution of the 27cooperative endeavor agreement and/or receipt of funding, and the state is authorized to 28financially participate in obligations created by such contracts, and the right-of-ways and 29servitudes acquired by the City are considered eligible expenses and may be used as local 30match for the project. Page 97 of 116 HLS 19RS-639 REENGROSSED HB NO. 2 1 (8) Notwithstanding anything contained in this Capital Outlay Act, or any 2previous Capital Outlay Act to the contrary, or any other provision of law, contracts may be 3entered into for the Westwego Fire Station, Planning and Construction in Jefferson Parish 4project, prior to receipt of funding and the state is authorized to financially participate in 5obligations created for such project. 6 (9) Notwithstanding anything in this Act or the Capital Outlay Act to the 7contrary or any other provision of law, contracts may be entered into for the Jail and Police 8Management Equipment for the City of New Orleans in Orleans Parish project prior to 9receipt of funding, the State is authorized to financially participate in obligations created by 10such contracts, and the project is exempted from all statutes relative to public bidding and 11contractual review. 12 (10) Notwithstanding anything contained in this Capital Outlay Act, or any 13previous Capital Outlay Act to the contrary, or any other provision of law to the contrary, 14contracts may be entered into for the full amount of the general obligation bond 15appropriation contained in this Act for the Airport Access Road in Iberia Parish project prior 16to receipt of funding and prior to the execution of the cooperative endeavor agreement, the 17State is authorized to financially participate in obligations created by such contracts, and the 18project shall be authorized to go to public bid. 19 (11) Notwithstanding anything in this Act or the Capital Outlay Act to the 20contrary or any other provision of law, contracts may be entered into for the Residential 21Capacity Expansion, Acquisition for Eden House in Orleans Parish project prior to receipt 22of funding, and the State is authorized to financially participate in obligations created by 23such contracts. 24 (12) Notwithstanding anything in this Act or the Capital Outlay Act to the 25contrary or any other provision of law, contracts may be entered into for the New Sewerage 26and Water Board Power Plant, Planning and Construction for the City of New Orleans in 27Orleans Parish project prior to receipt of funding and the State is authorized to financially 28participate in obligations created by such contracts. Page 98 of 116 HLS 19RS-639 REENGROSSED HB NO. 2 1 Section 8F. Pursuant to R.S. 39:112(E)(2), non-state entity projects shall require 2a match of not less than twenty-five percent of the total requested amount of funding; 3however, 4 (1) Notwithstanding the provisions of R.S. 39:112(E)(2), the project for 5Independence, Independence Area Community Pavilion, Planning and Construction, shall 6be exempt from all local match requirements. 7 (2) Notwithstanding anything contained in this Act or the Capital Outlay Act to 8the contrary, any other provisions of law, or the provisions of R.S. 39:112(E)(2), the project 9for Eden House, New Facility, Acquisition, Planning and Construction, shall be exempt from 10all local match requirements. 11 (3) Notwithstanding anything contained in this Act, the Capital Outlay Act, any 12other provision of law, or the provisions of R.S. 39:112(E)(2) to the contrary, the project for 13Lockport Street Improvements, Planning and Construction, shall be exempt from all local 14match requirements. 15 (4) Notwithstanding anything contained in this Act, any prior Capital Outlay Act, 16any other provision of law, or the provisions of R.S. 39:112(E)(2) to the contrary, the project 17for the Village of Doyline Wastewater Treatment Facility shall be exempt from all local 18match requirements. 19 Section 8G. Pursuant to R.S. 39:102, each capital outlay budget request 20submitted as required by R.S. 39:101 shall include a detailed project description and 21justification for each new project requested; however, 22 (1) Notwithstanding anything contained in this Act or the Capital Outlay Act 23to the contrary or any other provision of law, the scope of the appropriations made in the 24Capital Outlay Act or any other Capital Outlay Act for the St. Mary Parish Plantation Pump 25Station Replacement project shall be deemed to include repair, equipment, rehabilitation and 26infrastructure improvements at the existing Plantation Pump Station. 27 (2) Notwithstanding anything contained in this Act or the Capital Outlay Act to 28the contrary or any other provision of law, the scope of the appropriations made in this or 29any other Capital Outlay Act for the Louisiana 4-H Foundation, Youth Education Page 99 of 116 HLS 19RS-639 REENGROSSED HB NO. 2 1Development Camp Windy Wood project, shall be deemed to include planning, construction, 2and acquisition. 3 (3) Notwithstanding anything contained in this Act or the Capital Outlay Act to 4the contrary, or any other provision of law, the scope of the appropriations made in the 5Capital Outlay Act or any other Capital Outlay Act for the City of New Orleans, Eastern 6New Orleans Hospital and Medical Office Building, Real Estate Acquisition, Planning, 7Design, Construction, Renovation and Equipment project, the City of New Orleans may 8make such capital outlay funds available to the Parish Hospital Service District of the Parish 9of Orleans District "A" in furtherance of the District's planning, design, acquisition, 10development, renovation, construction, equipment and operation of a hospital and medical 11office building in Eastern New Orleans. 12 (4) Notwithstanding anything contained in this Act or the Capital Outlay Act to 13the contrary or any other provision of law, the scope of the appropriations made in the 14Capital Outlay Act or any other Capital Outlay Act for the Jefferson Parish Bonnabel Canal 15Rehabilitation and Bank Stabilization (Veterans Boulevard to West Esplanade), Planning 16and Construction project shall be deemed to include steel sheet pile bulkhead, and/or bank 17excavation and reshaping, bridge replacement, property acquisition, demolition and 18improvements needed to stabilize the canal bank along the Bonnabel Drainage Canal in 19order to address canal bank failures between Veterans Boulevard and West Esplanade 20Avenue. 21 (5) Notwithstanding anything contained in this Act or the Capital Outlay Act to 22the contrary or any other provision of law, the scope of the appropriations made in this or 23any other Capital Outlay Act for the New Orleans West Bank Park Improvements, New 24Soccer and Recreational Facilities, and Skateboard Park project and the Norman Playground 25Basketball Gym, Planning and Construction project shall be deemed to include the George 26W. Carver Playground, Renovations and Upgrades project for the West Bank Park project 27and park enhancements for a walking track, basketball, football and baseball fields and a 28concession stand for the Norman Playground project. 29 (6) Notwithstanding anything contained in this Act or the Capital Outlay Act to 30the contrary or any other provision of law, the Parks Municipal Complex, Planning and Page 100 of 116 HLS 19RS-639 REENGROSSED HB NO. 2 1Construction project shall include the purchase, construction or renovation of a new facility 2in St. Martin Parish. 3 (7) Notwithstanding anything contained in this Act or the Capital Outlay Act to 4the contrary or any other provision of law, The Vernon/Fort Polk Thoroughfare Electrical 5Power Extension project shall include Utilities Including Generators. 6 (8) Notwithstanding anything in this Act, the Capital Outlay Act, any previous 7capital outlay act, or other provision of law to the contrary, the scope of the appropriation 8for the Port of South Louisiana Globalplex Terminal Building #71 Upgrade project shall be 9deemed to also include similar upgrades for other Globalplex Terminal Buildings. 10 (9) Notwithstanding anything contained in this Act, the Capital Outlay Act, or 11any other provision of law to the contrary, the scope of the appropriation for the Department 12of Transportation and Development, LA 22 Improvements (LA 16 to Diversion Canal), 13Planning and Construction (Livingston) is deemed to also include the overlay of LA 22 from 14Head of Island to Chinquapin Bridge. 15 (10) Notwithstanding anything contained in the Act or a previous Capital Outlay 16Act, any provision of law, or in any cooperative endeavor agreement between the Office of 17Facility Planning and Control and Westwego, the scope of the appropriations in this or any 18previous Capital Outlay Act for Westwego, The WHARF project shall be deemed to include 19site preparation. 20 (11) Notwithstanding anything contained in the Act or the Capital Outlay Act 21to the contrary or any other provision of law, the Slip Dredging and Improvements for the 22Terrebonne Port Commission Government Multi-Use Complex, Planning and Construction 23project shall be deemed to include Houma Navigation Canal Dredging. 24 (12) Notwithstanding anything contained in this Act or a previous Capital Outlay 25Act, any provision of law, or in any cooperative endeavor agreement between the Office of 26Facility Planning and Control and the Pontchartrain Levee District, the scope of the 27appropriations in this or any previous Capital Outlay Act for the Pontchartrain Levee 28District, East St. Charles Urban Flood Control project shall be deemed to include planning, 29design, and construction of the East St. Charles Urban Flood Control project, including the Page 101 of 116 HLS 19RS-639 REENGROSSED HB NO. 2 1Almedia, St. Rose, and Airport Pump Stations located in the eastern end of the East Bank 2of St. Charles Parish. 3 (13) Notwithstanding anything contained in this Act, the Capital Outlay Act, or 4any other Capital Outlay Act, the scope of the appropriation for the Department of 5Transportation and Development, Jimmie Davis Bridge Rehabilitation and Lighting, 6Planning and Construction project in Bossier and Caddo parishes, shall be deemed to include 7the planning, design and construction of a new bridge. 8 (14) Notwithstanding anything contained in this Act or any other Capital Outlay 9Act, the scope of the appropriation for the Jean Lafitte, Seafood Pavilion, Planning and 10Construction project in Jefferson Parish shall be deemed to include the planning, design, and 11construction of a Seafood Market. 12 (15) Notwithstanding anything contained in this Act or any other Capital Outlay 13Act, the scope of the appropriation for the False River Ecosystem Restoration Project, 14Planning and Construction project in Pointe Coupee Parish shall be deemed to include 15bulkhead replacement. 16 Section 8H. Notwithstanding anything contained in this Act or the Capital Outlay 17Act, or in any cooperative endeavor agreement between the Office of Facility Planning and 18Control and the City of New Orleans or the Hospital Service District to the contrary, the 19Hospital Service District may mortgage or otherwise encumber any and all land, real estate 20property, including buildings and equipment, and appurtenances acquired, in whole or part, 21with state capital outlay funds provided that bond counsel to the state opines that such 22mortgage shall not affect the tax-exempt status of the bonds to be issued by the state for the 23project. 24 Section 8I. Notwithstanding anything contained in this Act or the Capital Outlay 25Act to the contrary or any other provision of law, the Parish Road Improvements Project for 26Franklin Parish is exempt from the contract limit set forth in R.S. 38:2212. 27 Section 8J. Notwithstanding anything contained in this Act or the Capital Outlay 28Act to the contrary or any other Act or provision of law, the appropriations made for the 29Executive Department for facilities which promote economic development included in the 30Repair, Restoration, and Replacement for Hurricanes Katrina and Rita project, and the Page 102 of 116 HLS 19RS-639 REENGROSSED HB NO. 2 1Department of Economic Development projects are for public purposes pursuant to the 2provisions of Article VII, Section 14 of the Constitution of Louisiana primarily for economic 3development, including the generation of tax revenues, creation of jobs, promotion of 4tourism, and creation of facilities for charitable, cultural, artistic, educational, social, civic, 5research, service, economic development activities, or provide facilities for professional golf 6events, pursuant to the terms of cooperative endeavor agreements, including leases and all 7expenditures of these appropriations and may be exempted, by the Commissioner of 8Administration, from all statutes relative to public bidding, contractual review and the 9provisions of R.S. 33:9029.2(D) and in lieu thereof be allowed to use alternative competitive 10contracting arrangements where the appropriate administering entity submits documentation 11to the Commissioner of Administration substantiating that it is in the best interest of the 12citizens of the state, due to economic and/or operational benefits, and the necessity to 13complete the projects in a timely manner; and, the appropriate administering entity shall 14have the authority to directly appoint the design professional from a list of a minimum of 15three design firms or joint ventures with the appropriate specialized facility design 16experience submitted to and acceptable to the Commissioner of Administration and shall be 17exempt from other state requirements for selection of designers, and may include 18expenditures for computers, fixtures, furniture, and other equipment as such is deemed to 19be capital outlay in nature, and unless the Commissioner of Administration is advised by 20bond counsel to the State that such may violate federal tax law, may be used to reimburse 21any expenditure made prior to the granting of a line of credit or the sale of bonds by the State 22Bond Commission, determination by the State Treasurer that cash funding has been 23deposited in the Comprehensive Capital Outlay Escrow Account for the project or the 24execution of a cooperative endeavor agreement from the Office of Facility Planning and 25Control, and may be used to acquire land or real property, the title to which is held in the 26name of an entity exempt from taxation under the provisions of 26 U.S.C. 501(c)(3). 27 Section 8K. Notwithstanding anything contained in this Act or the Capital Outlay 28Act to the contrary or any other provision of law, all of the funds herein appropriated to the 29Department of Economic Development in connection with the Capital Improvements Project 30to Meet Economic Development Commitments for which the Department of Economic Page 103 of 116 HLS 19RS-639 REENGROSSED HB NO. 2 1Development utilizes a cooperative endeavor agreement to further economic development 2as permitted under Article VII, Section 14 of the Louisiana Constitution, including the 3generation of tax revenues and creation of jobs, shall be considered as having been 4appropriated to the Department of Economic Development, may be used to reimburse any 5expenditure made prior to the granting of a line of credit and made prior to the execution of 6a cooperative endeavor agreement and shall be administered solely by the Department of 7Economic Development pursuant to, in compliance with, and on the terms contained in such 8cooperative endeavor agreements. 9 Section 8L. Notwithstanding any other provision of this Act or the Capital 10Outlay Act or any other provision of law to the contrary, all of the funds herein appropriated 11to the Department of Economic Development in connection with projects or programs for 12which the Department of Economic Development utilizes a cooperative endeavor agreement 13to further economic development as permitted under Article VII, Section 14 of the Louisiana 14Constitution, including the generation of tax revenues and creation of jobs, shall be 15considered as having been appropriated to the Department of Economic Development, may 16be used to reimburse any expenditure made prior to the granting of a line of credit and made 17prior to the execution of a cooperative endeavor agreement and shall be administered solely 18by the Department of Economic Development pursuant to, in compliance with, and on the 19terms contained in such cooperative endeavor agreements without compliance with any other 20law, including, but not limited to, the provisions of R.S. 39:101 through 128. Additionally, 21all expenditures of these appropriations may be exempted by the Commissioner of 22Administration, from all statutes relative to public bidding, contractual review and the 23provisions of R.S. 33:9029.2(D). 24 Section 8M.(1) Notwithstanding any other provision of this Act or the Capital 25Outlay Act or any other provision of law to the contrary, funds appropriated for the 26Economic Development Award Program project for the Office of Business Development 27are to be used solely for capital and infrastructure improvements subject to verification by 28the Division of Administration, Office of Facility Planning and Control. 29 (2) Eligible expenses for Economic Development Award Program funds may 30include documented project expenses beginning on the date of LEDC Board approval of the Page 104 of 116 HLS 19RS-639 REENGROSSED HB NO. 2 1project and may be reimbursed upon execution of the cooperative endeavor agreement for 2the project. 3 Section 8N. Notwithstanding any provision of law to the contrary, the 4Commissioner of Administration is hereby authorized to take such actions as are necessary, 5including using such funds as may be available including those appropriated and available 6under this Act or the Capital Outlay Act for professional sports facilities through the 7Louisiana Stadium and Exposition District and that are otherwise available, executing on 8behalf of the State such documents as are necessary in order to terminate the ground lease 9between the State and the PGA and thereby acquiring all leasehold improvements for the 10State, extending the management agreement between the State and the PGA, and extending 11the sponsorship and presence of the Zurich Classic in the Greater New Orleans area. 12 Section 8O. Notwithstanding anything in this Act, any previous capital outlay 13act, or other provision of law to the contrary, monies appropriated herein for the Port of 14South Louisiana Globalplex Terminal Building #71 and Other Globalplex Terminal Building 15Upgrades, Planning and Construction may be expended for design fees related to the 16conveyor system and ancillary equipment that exceed the customary ten percent limitation 17on design fee costs. 18 Section 8P. Notwithstanding anything in this Act to the contrary or any other 19provision of law, monies appropriated herein for the Juban Road (LA1026) Widening (I-12 20to US 190) project may be expended for the installation of sewer lines along the roadway 21and pursuant to a cooperative endeavor agreement between the Department of 22Transportation and Development and Livingston Parish, funds may be provided to 23Livingston Parish for that purpose. 24 Section 8Q. The new University Medical Center in New Orleans project in 25Orleans Parish shall be exempt from the state's requirements for selection of designers and 26the Commissioner of Administration shall have the authority to approve a design 27professional selection process. The design professional fee shall be in accordance with state 28guidelines administered by the Office of Facility Planning and Control, Division of 29Administration. Page 105 of 116 HLS 19RS-639 REENGROSSED HB NO. 2 1 Section 8R.(1) The Division of Administration, Office of Facility Planning and 2Control, with approval of the Commissioner of Administration and the Joint Legislative 3Committee on the Budget, is authorized to use alternative delivery strategies in 4implementing hurricane damage repairs to Southern University at New Orleans, Hazardous 5Material Abatement Projects, the City Park Golf Complex Improvements project, the 6Health/Human Performance Education Complex, and the Patrick Taylor Hall Renovation 7and Expansion project. 8 (2) In addition, with the approval of the Commissioner of Administration and 9the Joint Legislative Committee on the Budget, an alternative delivery strategy may be used 10in the implementation of the Louisiana Children's Museum, Early Learning Village project. 11 Section 8S.(1) Due to the State's current investment in TPC Louisiana and the 12financial support it provides to the PGA TOUR event currently played at said facility, the 13funding of the City Park Golf Complex Improvements project described above is 14conditioned upon said PGA TOUR event not being played at New Orleans City Park Golf 15Complex without the prior agreement of the Commissioner of Administration and the 16Chairman of the Jefferson Parish Council. 17 (2) Notwithstanding the foregoing, the City Park Golf Complex may host any 18other golf tournament or event, including but not limited to any other PGA-affiliated or 19sponsored tournament or event. 20 Section 8T.(1) For all projects administered by the Office of Facility Planning 21and Control and payable from proceeds of self-generated revenues, funds shall be remitted 22to the Office of Facility Planning and Control for deposit in the state treasury at such time 23as may be deemed necessary by the Office of Facility Planning and Control in order to cover 24the amount of contracts or other project expenses. 25 (2) Notwithstanding any provisions contained herein or any other law to the 26contrary, for projects with other means of financing provided to the administering agency 27by interagency transfer, the authority to draw these funds shall remain with the user agency. 28 (3) Any revenue bonds appropriated in Section 1 of the Capital Outlay Act shall 29not be secured by the full faith and credit of the state. Page 106 of 116 HLS 19RS-639 REENGROSSED HB NO. 2 1 (4) The State Treasurer shall refund to the appropriate source any surplus self- 2generated funds, advanced insurance funds received by the Office of Facility Planning and 3Control as Interagency Transfer from Office of Risk Management associated with hurricane 4damage recovery, and interest earned on these funds, provided the Treasurer's Office is 5notified, when these funds are deposited in the state treasury, that the user agency or Office 6of Risk Management intends to request a refund of this interest. 7 Section 8U.(1) Notwithstanding anything in this Act or the Capital Outlay Act 8to the contrary or any other provision of law, contracts may be entered into for the Tulane 9University Tulane River and Coastal Center Project prior to receipt of funding and prior to 10the execution of a cooperative endeavor agreement, and the project is exempted from all 11statutes relative to public bidding and state procurement and in lieu thereof shall be subject 12to federal government qualifications and regulations approved by the Economic 13Development Authority. 14 (2) Notwithstanding anything contained in this Act or the Capital Outlay Act or 15any other provision of law to the contrary, contracts may be entered into for the City of 16Gretna’s Lion’s Club Conversion to Senior Center project prior to receipt of funding and 17prior to execution of a cooperative endeavor agreement and the project is exempted from all 18statutes relative to public bidding and contractual review. 19 Section 8V. Notwithstanding anything contained in this Act, the Capital Outlay 20Act, or any other provision of law to the contrary, the letting of a contract for construction 21of the "Louisiana Construction Center", funded wholly by the Louisiana Licensing Board 22for Contractors, shall be exempt from all statutes relative to public bidding and contractual 23review. 24 Section 8W. Notwithstanding anything contained in this Act, the Capital Outlay 25Act, or any other provision of law to the contrary, the Department of Transportation and 26Development shall use $2,500,000 of general obligation bond funding appropriated for 27Department of Transportation and Development, Administration, Highway Program (Up to 28$4,000,000 for Secretary's Emergency Fund) in Act 25 of the 2014 Regular Session of the 29Legislature for the Louisiana Highway 92 Overlay, Preservation and Construction 30(Lafayette) project. Page 107 of 116 HLS 19RS-639 REENGROSSED HB NO. 2 1 Section 8X. Notwithstanding anything contained in this Act, the Capital Outlay 2Act, or any other provision of law to the contrary, $50,000 of the appropriation for 3Department of Natural Resources, Office of the Secretary, Atchafalaya Basin Protection and 4Enhancement (Federal Match and Local/Sponsor Match)(Assumption, Avoyelles, Iberia, 5Iberville, Pointe Coupee, St. Landry, St. Martin, St. Mary) will be used to fund House 6Concurrent Resolution No. 168 of 2011. 7 Section 8Y. Notwithstanding any provisions contained in this Act, the Capital 8Outlay Act, or any other provision of law to the contrary, any funds expended by the Parish 9of St. Mary for the purpose of securing a federal grant, for the Infrastructure Improvements 10and Construction of a Welding Training Center Facility at the Charenton Canal Industrial 11Park, shall be eligible for reimbursement from any cash line of credit approved for the 12project. 13 Section 8Z. Notwithstanding any provision contained herein or any other 14provision of law to the contrary, the Department of Transportation and Development is 15authorized to enter into a cooperative endeavor agreement with the City of New Orleans and 16the New Orleans Aviation Board for the Landside Roadways at Louis Armstrong 17International North Terminal, Planning and Construction in Jefferson Parish. Furthermore 18the capital outlay request application for this project submitted by the City of New Orleans 19shall govern the scope of the project. 20 Section 8AA. Notwithstanding anything contained in this Capital Outlay Act, or any 21previous Capital Outlay Act to the contrary, or any other provision of law, the Department 22of Public Safety and Corrections, youth services, office of juvenile justice, may finance the 23the Office of Juvenile Justice, Community Based Program, Juvenile Justice Improvements, 24Planning, Construction, Renovation, Acquisition, and Equipment (Statewide) project through 25the issuance of revenue bonds by the Louisiana Correctional Facilities Corporation to be 26secured by and payable from State appropriations. The issuance of such revenue bonds shall 27require the approval of the State Bond Commission. 28 Section 9. Notwithstanding any provisions contained herein or any other law to the 29contrary, the provisions of Chapter 16 of Subtitle III of Title 39 of the Louisiana Revised 30Statutes of 1950 as amended, shall not apply to architectural and engineering contracts, Page 108 of 116 HLS 19RS-639 REENGROSSED HB NO. 2 1administered by the office of facility planning and control, division of administration 2pursuant to this or any other capital outlay act. 3 Section 10. All funds appropriated herein to the office of facility planning and 4control, division of administration, on behalf of non-state entities, and administered by 5cooperative endeavor agreements pursuant to this Act shall be expended within two (2) years 6from the date of the issuance of the bonds. The office of facility planning and control, 7division of administration, agrees that it will notify the non-state entity of the date the bonds 8are issued within three (3) months from the issuance thereof. The non-state entity 9understands and agrees that if the funds appropriated herein and administered under 10cooperative endeavor agreements pursuant to this Act are not totally expended within two 11(2) years from the issuance of the bonds, the office of facility planning and control, division 12of administration, can close the project and recommend that the legislature reallocate any 13unexpended proceeds to other projects. 14 Section 11. Notwithstanding any provisions contained herein or law to the contrary, 15the proceeds of revenue bonds to be utilized to fund certain projects authorized in Section 161 hereof may, in accordance with Article VII, Section 9 of the Louisiana Constitution of 171974, be deposited in special accounts held outside the state treasury in accordance with the 18provisions of any bond resolution, indenture, reimbursement contract, or other bond or 19financing covenant which provides for the pledge of such funds in connection with the 20issuance of revenue bonds. For all projects administered by the office of facility planning 21and control, division of administration, authorized in Section 1 hereof which are payable 22from the proceeds of revenue bonds, only the office of facility planning and control, division 23of administration, will be authorized to requisition funds from the special accounts described 24immediately above, at such time or times as may be deemed necessary by the office of 25facility planning and control, division of administration, in order to cover contract amounts 26or other project expenses. 27 Section 12. The governor shall have the power to veto any line-item in this Act. 28 Section 13. Except as otherwise provided herein, no funds shall be expended on any 29highway projects on highways within the state highway system as established in R.S. 48:191 30under the jurisdiction of the Department of Transportation and Development unless and until Page 109 of 116 HLS 19RS-639 REENGROSSED HB NO. 2 1such project is in the Highway Program, R.S. 48:228 through 232, approved by the Joint 2Legislative Committee on Transportation, Highways and Public Works. Pursuant to R.S. 349:214.6.2(B), no integrated coastal protection construction project shall be undertaken with 4funds included in this bill except those included in an annual plan finally approved by the 5legislature in accordance with the provisions of R.S. 49:214.5.3. No funds appropriated to 6the Coastal Protection and Restoration Authority in this Act as a contribution for a project 7cost-share or otherwise, for the national economic development and national ecosystem 8restoration components of the Southwest Coastal Louisiana Study shall be used or provided 9for the expropriation of property or use of eminent domain, except where such funds are to 10be used to obtain property voluntarily offered for project purposes, where at least seventy- 11five percent of the owners have voluntarily offered the property, or where the record or 12apparent owners have voluntarily offered the property but do not have clear title. 13 Section 14. The word "statewide" used in place of the specific parish designation for 14projects contained in this Act indicates that the project or program is applicable to all sixty- 15four parishes in the state. The description of any project in this Act shall be deemed to 16include planning, design, master planning, studies, permits, surveys, testing, construction, 17land and/or building/improvement acquisition, reconstruction, renovation, repair, right of 18way and utilities, site and other improvements, miscellaneous/contingencies, lease hold 19improvements ultimately owned by the state or a political subdivision of the state, equipment 20and other acquisitions, and any other component of the project if such are included or 21indicated in the capital outlay request for such projects required by R. S. 39:101 subject to 22the provisions of Title 39 of the Louisiana Revised Statutes. For new construction or 23renovation projects, equipment or other acquisitions, which can reasonably be considered 24necessary for the facility to be functional, may be deemed to be included in the project, even 25if such equipment or other acquisitions are not included or indicated in the project name or 26the capital outlay request. When local or federal match is referenced in a project title, but 27only a portion of the state appropriation is granted a line of credit or otherwise funded, then 28the amount of local or federal match, required to be made available, may be prorated relative 29to the amount of state appropriation made available through lines of credit. The provisions, items, and projects contained in this Act are severable 2and if any provision, item, or project contained herein, or the application of any such 3provision, item, or project, is held invalid, such invalidity shall not affect other provisions, 4items, projects, or applications of the Act which can be given effect without the invalid 5provision, project, item, or application. 6 Section 16. Notwithstanding any other provisions of law to the contrary, the state 7shall not grant cash lines of credit, or authorize or issue general obligation bonds in a 8principal amount in excess of $837,205,000 for Fiscal Year 2019-2020. 9 Section 17. Notwithstanding any contrary provision of this Act or any contrary 10provision of law, no funds appropriated by this Act shall be released or provided to any 11recipient of an appropriation made in this Act if, when, and for as long as, the recipient fails 12or refuses to comply with the provisions of R.S. 24:513. No recipient shall be considered 13to fail or refuse to comply with the provisions of R.S. 24:513 pursuant to this Section during 14any extension of time granted by the legislative auditor to the recipient to comply. 15 Section 18. This Act shall become effective upon signature by the governor or, if not 16signed by the governor, upon expiration of the time for bills to become law without signature 17by the governor, as provided in Article III, Section 18 of the Constitution of Louisiana. If 18vetoed by the governor and subsequently approved by the legislature, this Act shall become 19effective on the day following such approval.
