COURTS/CITY:  Provides relative to Baton Rouge City Court probation officers
1	AN ACT
2To enact R.S. 13:2071.1, relative to Baton Rouge City Court; to authorize the commission
3 of probation officers; to recognize the Baton Rouge City Court Probation Division
4 as a law enforcement agency; to provide relative to the duties of Baton Rouge City
5 Court probation officers; to provide relative to P.O.S.T.-certified training; and to
6 provide for related matters.
7Be it enacted by the Legislature of Louisiana:
8 Section 1.  R.S. 13:2071.1 is hereby enacted to read as follows: 
9 ยง2071.1.  Baton Rouge City Court; probation officers
10	A. The clerk of court and judicial administrator of Baton Rouge City Court
11 shall have authority to commission Baton Rouge City Court probation officers, one
12 of whom may be designated as chief of probation.  The Baton Rouge City Court
13 Probation Division shall be recognized as a law enforcement agency.
14	B.  Baton Rouge City Court probation officers shall be required to
15 successfully complete a certified Peace Officer Standards and Training program and,
16 upon successful completion of such training, shall be considered Louisiana peace
17 officers and commissioned probation officers.
18	C. Baton Rouge City Court probation officers shall have the power and
19 authority to make arrests, serve notices, orders, subpoenas, and writs, conduct
20 authorized home visits, job verifications, conduct verifications of Baton Rouge City

1 Court warrants, execute all orders, and perform any other duties incidental to their
2 office.  Nothing in this Section shall be construed to relieve the sheriff or constable
3 from the duties as set forth in R.S. 13:5539.
4	D.  Employment of probation officers by Baton Rouge City Court for its
5 exclusive service shall in no way be affected by or limit the court in availing itself
6 of the services of such officers or other employees as may be provided by the state
7 or the city of Baton Rouge.

Abstract:  Provides for the commission of Baton Rouge City Court probation officers and
provides for their duties and training.
Proposed law authorizes the clerk of court and judicial administrator of Baton Rouge City
Court to commission Baton Rouge City Court probation officers.  Provides that Baton Rouge
City Court probation division be considered a law enforcement agency.  Requires probation
officers to be P.O.S.T.-certified.  Additionally, proposed law provides that the probation
officers will have duties in and out of the courtroom including the authority to arrest.
