HEALTH CARE: Provides relative to prohibited employment of licensed ambulance personnel or nonlicensed persons convicted of certain offenses 1 AN ACT 2To amend and reenact R.S. 40:1203.3(A)(1), relative to ambulance personnel; to prohibit the 3 employment of licensed ambulance personnel or nonlicensed persons convicted of 4 certain offenses; to remove an outdated reference; and to provide for related matters. 5Be it enacted by the Legislature of Louisiana: 6 Section 1. R.S. 40:1203.3(A)(1) is hereby amended and reenacted to read as follows: 7 ยง1203.3. Refusal to hire or contract; termination of employment; exemption; appeal 8 procedure; waiver 9 A. Except as otherwise provided in R.S. 40:1203.2(C), no employer shall 10 hire any licensed ambulance personnel or nonlicensed person when the results of a 11 criminal history check reveal that the licensed ambulance personnel or nonlicensed 12 person has been convicted of any of the following offenses: 13 (1) R.S. 14:28.1, 30, 30.1, 31, 32.6, 32.7, 32.12, 34, 34.1, 34.7, 35.2, 37, 14 37.1, 37.4, 38.1, 42, 42.1, 43, 43.1, 43.2, 43.3, 43.5, 44, 44.1, 46.2, 51, 60, 62.1, 64, 15 64.1, 64.4, 66, 67.16, 89, 89.1, 93.3, 93.4, 93.5, 283.3 or distribution or possession 16 with the intent to distribute controlled dangerous substances as listed in Schedules 17 I through V of the Uniform Controlled Dangerous Substances Act. 18 * * * Page 1 of 2 CODING: Words in struck through type are deletions from existing law; words underscored are additions. [R.S. 1:13(B) and 24:177(E)] HB 230 Original 2019 Regular Session Mike Johnson Abstract: Adds to the enumerated list, certain offenses that will prohibit individuals from obtaining employment as a licensed ambulance personnel or nonlicensed person. Present law provides for the prohibition of employers from hiring licensed ambulance personnel or nonlicensed person when they have been convicted of certain criminal offenses enumerated within present law. Proposed law removes a reference to R.S. 14:62.1, which has been repealed. Proposed law adds the crime of identity theft to the list of prohibited offenses that would prohibit employment as a licensed ambulance personnel or nonlicensed person. Proposed law adds the crime of abuse of persons with infirmities through electronic means to the list of prohibited offenses that would prohibit employment as a licensed ambulance personnel or nonlicensed person.
