HOUSE BILL NO. 264
BY REPRESENTATIVE HILFERTY
DISTRICTS/CRIME PREVENT:  Increases the maximum parcel fee authorized to be levied
in the Lakeshore Crime Prevention District and provides relative to the purpose of
the district
1	AN ACT
2To amend and reenact R.S. 33:9091.7(C) and (F)(1) and (3)(b) and (c), relative to the
3 Lakeshore Crime Prevention District in Orleans Parish; to provide relative to the
4 purpose of the district; to provide relative to the parcel fee levied within the district;
5 to provide relative to the maximum amount and expiration of the fee; and to provide
6 for related matters.
7	Notice of intention to introduce this Act has been published
8	as provided by Article III, Section 13 of the Constitution of
9	Louisiana.
10Be it enacted by the Legislature of Louisiana:
11 Section 1.  R.S. 33:9091.7(C) and (F)(1) and (3)(b) and (c) are hereby amended and
12reenacted to read as follows:
13 ยง9091.7.  Lakeshore Crime Prevention District

15	C.  Purpose.  The purpose of the district shall be to aid in crime prevention
16 by:
17	(1)  Procuring private patrol services, security cameras, and to add to other
18 products or services reasonably designed to enhance the security of district residents

1 by providing for an increase in the presence of law enforcement personnel in the
2 district.
3	(2)  Disseminating newsletters or other information on crime prevention or
4 security matters.
5	(3)  Engaging in other activities ancillary to crime prevention.

7	F.  Parcel fee.  The governing authority of the city of New Orleans is hereby
8 authorized to impose and collect a parcel fee within the district subject to and in
9 accordance with the provisions of this Subsection:
10	(1)  The amount of the fee shall be as requested by duly adopted resolution
11 of the governing authority of the district.  The fee, however, shall not exceed three
12 hundred sixty dollars four hundred twenty dollars per parcel per year.

16	(b)  The election on the question of the imposition of the fee shall be held at
17 the same time as the regularly scheduled election in the city of New Orleans to be
18 held on November 2, 2004, or, if not held on that date, it shall be held at the same
19 time as a regularly scheduled election in the city of New Orleans held after that date.
20	(c)  The fee shall expire on December 31, 2010, at the end of the term
21 provided for in the proposition authorizing the fee but may be renewed as provided
22 in Subparagraph (3)(a) of this Subsection.  Any election to authorize renewal of the
23 fee shall be held for that purpose in accordance with the Louisiana Election Code. 
24 If the fee is renewed, the term of the imposition of the fee shall be as provided in the
25 proposition authorizing such renewal, not to exceed four years.

27 Section 2.  The provisions of this Act shall not affect the parcel fee levied within the
28Lakeshore Crime Prevention District on the effective date of this Act.  The governing
29authority of the city of New Orleans shall continue to levy the fee until such time as it

1expires, as provided in the proposition approved by a majority of the district's registered
2voters voting on the proposition at an election held on November 8, 2016.  After expiration
3of the fee, the governing authority of the city shall then begin to levy a parcel fee as provided
4in this Act if the parcel fee has been approved by the voters as provided in this Act.

Abstract:  Provides relative to the parcel fee levied within the Lakeshore Crime Prevention
District in Orleans Parish and to the purpose of the district.
Present law creates the Lakeshore Crime Prevention District in Orleans Parish as a political
subdivision for the purpose of aiding in crime prevention and adding to the security of
district residents by providing for an increase in the presence of law enforcement personnel
in the district.
Proposed law retains present law.
Present law provides that the purpose of the district shall be to aid in crime prevention and
to add to the security of district residents by providing for an increase in the presence of law
enforcement personnel in the district.  Proposed law provides that the purpose of the district
shall be to aid in crime prevention through the following:
(1)By procuring private patrol services, security cameras, and other products or services
reasonably designed to enhance the security of district residents.
(2)By disseminating newsletters or other information on crime prevention or security
matters.
(3)By engaging in other activities ancillary to crime prevention.
Present law authorizes the governing authority of the city of New Orleans, subject to voter
approval, to impose a parcel fee on behalf of the district.  Provides that the fee is a flat fee
per improved parcel of land not to exceed $360 per improved parcel per year.  Proposed law
increases the maximum rate of the fee from $360 to $420 per improved parcel per year.
Present law provides that the fee shall expire on Dec. 31, 2010, but authorizes renewal of the
fee, subject to voter approval.  Proposed law provides that the fee shall expire at the end of
the term provided for in the proposition authorizing the fee.
Proposed law provides that the provisions of the Act have no effect on the parcel fee being
imposed within the district on the effective date of the Act.  Provides that the fee shall
continue to be imposed until it expires after which the fee authorized by proposed law may
be levied.
