HLS 19RS-877 ORIGINAL 2019 Regular Session HOUSE BILL NO. 300 BY REPRESENTATIVE CARMODY PUBLIC SERVICE COMN: Provides with respect to fees paid to the Public Service Commission by motor carriers 1 AN ACT 2To amend and reenact R.S. 45:169 and 180.1(D), relative to motor carriers; to provide with 3 respect to fees paid to the Public Service Commission for the issuance of a common 4 carrier certificate, contract carrier permit, or a wrecker license; to provide with 5 respect to filing fees; to provide that the commission determines the amounts of the 6 fees; and to provide for related matters. 7Be it enacted by the Legislature of Louisiana: 8 Section 1. R.S. 45:169 and 180.1(D) are hereby amended and reenacted to read as 9follows: 10 §169. Fees; disposition; refunds; credits; prescription 11 A. Every motor carrier as defined in R.S. 45:162 regularly operating, or 12 which shall regularly operate in the state, is hereby required to pay to the Louisiana 13 Public Service Commission a special fee of ten dollars as prescribed by the 14 commission for each motor vehicle or combination of vehicles operated or to be 15 operated by the motor carrier. This special fee shall be paid at the time of the 16 issuance of a common carrier certificate or contract carrier permit and shall be due 17 each year thereafter between January first and February first. In case of emergency 18 or unusual temporary demands for transportation, the fee for additional motor 19 vehicles for a shorter period shall be fixed by the commission in such reasonable 20 amounts as may be prescribed by general rule or temporary order. HLS 19RS-877 ORIGINAL HB NO. 300 1 for a common carrier certificate or contract carrier permit shall be accompanied by 2 a filing fee of fifty dollars as prescribed by the commission and every application for 3 a permit shall be accompanied by a filing fee of twenty-five dollars as prescribed by 4 the commission, which fees shall be in addition to other fees and taxes and shall be 5 retained by the commission whether the common carrier certificate or contract 6 carrier permit be granted or not. 7 * * * 8 §180.1. Wreckers and towing services 9 * * * 10 D. No person shall engage in the business of the operation and use of 11 wreckers and towing services without first having obtained from the commission a 12 wrecker license, the number of which shall be displayed on both sides of every 13 wrecking vehicle he operates. Present law requires that every motor carrier as defined in present law (R.S. 45:162) pay a special fee to the Louisiana Public Service Commission (commission) for each vehicle or combination of vehicles operated by the motor carrier. Proposed law changes present law to delete the $10 fee specification and provide instead that the commission prescribes the amount of the fee. Present law provides that the special fee shall be paid annually between January 1 and February 1 at the time of the issuance of the common carrier certificate or contract carrier permit. Proposed law retains present law. Present law allows the commission to fix an additional fee in a reasonable amount for any emergency or temporary demand for transportation. Present law requires that every application for a common carrier certificate or contract carrier permit include a filing fee of $50 and every application for a permit shall include a filing fee of $25 in addition to any other fees and taxes. Present law requires persons engaged in the business operation and use of wreckers and towing services to obtain a wreckers license and display the number on the side of the vehicle in operation. Proposed law retains present law. Present law provides for a fee of up to $10 per wrecker license. Proposed law deletes the specific amount range and provides that the commission will determine the amount of the fee.
