MTR VEHICLE/LICEN PLATES: Creates the "Louisiana REALTORS" special prestige license plate 1 AN ACT 2To enact R.S. 47:463.202, relative to motor vehicle special prestige license plates; to 3 establish the "Louisiana REALTORS" special prestige plate; to provide for creation, 4 issuance; design, fees, distribution, and rule promulgation applicable to such license 5 plates; and to provide for related matters. 6Be it enacted by the Legislature of Louisiana: 7 Section 1. R.S. 47:463.202 is hereby enacted to read as follows: 8 ยง463.202. Special prestige license plate; "Louisiana REALTORS" 9 A. The secretary of the Department of Public Safety and Corrections shall 10 establish a special prestige motor vehicle license plate to be known as the "Louisiana 11 REALTORS" plate, provided there is a minimum of one thousand applicants for 12 such plate. The plate shall be restricted to use on passenger cars, pickup trucks, 13 recreational vehicles, motorcycles, and vans. 14 B. The secretary shall work in conjunction with the Louisiana Realtors 15 Association to select the color and design of the plate, provided it is in compliance 16 with R.S. 47:463(A)(3). The design shall include the words "Louisiana 17 REALTORS". 18 C. The special prestige license plate shall be issued, upon application, to any 19 member or affiliate of the Louisiana Realtors Association upon verifying Page 1 of 3 CODING: Words in struck through type are deletions from existing law; words underscored are additions. HLS 19RS-838 ORIGINAL HB NO. 317 1 membership in a manner that is mutually determined by the secretary and the board 2 of directors of the Louisiana Realtors Association. 3 D. The department shall collect an annual royalty fee of ten dollars that shall 4 be disbursed in accordance with Subsection E of this Section. This fee shall be in 5 addition to the standard motor vehicle license tax imposed by Article VII, Section 6 5 of the Constitution of Louisiana, and a handling fee of three dollars and fifty cents 7 for each plate to be retained by the department to offset a portion of administrative 8 costs. 9 E.(1) The annual royalty fee shall be collected by the department and 10 forwarded to the Louisiana Realtors Relief Fund. The monies in the fund shall be 11 utilized to provide financial relief to realtors and others following a disaster and as 12 permitted by that entity's bylaws. 13 (2) The amount forwarded to the Louisiana Realtors Relief Fund shall be 14 deemed to be a charitable donation to that entity by the applicant. 15 (3) Application for the license plate created pursuant to this Section shall 16 constitute prior written consent and instruction by the applicant to the department to 17 provide his name, address, and birth date to the Louisiana Realtors Association. The 18 secretary shall ensure that the application for the plate includes a statement granting 19 such consent. 20 F. The secretary shall promulgate and adopt rules and regulations as are 21 necessary to implement the provisions of this Section. Realtors Assoc. upon verifying membership in a manner that is mutually determined by the secretary and the board of directors of the La. Realtors Assoc. Proposed law requires the department collect an annual royalty fee of $10 in addition to the standard motor vehicle license tax and a $3.50 handling fee for each plate to be retained by the department to offset a portion of administrative costs. Proposed law requires the department to forward the royalty monies to the La. Realtors Relief Fund. Proposed law requires the secretary promulgate and adopt rules and regulations to implement the provisions provided in proposed law.
