HEALTH/BEHAVIORAL: Exempts certain school-based behavioral health service
providers from the Behavioral Health Services Provider Licensing Law
1 AN ACT
2To amend and reenact R.S. 40:2154(A)(12), relative to behavioral health services providers;
3 to exempt certain school-based psychologists and social workers from certain
4 behavioral health services provider licensing requirements; to provide criteria for
5 such exemption; and to provide for related matters.
6Be it enacted by the Legislature of Louisiana:
7 Section 1. R.S. 40:2154(A)(12) is hereby amended and reenacted to read as follows:
8 ยง2154. Applicability
9 A. The provisions of this Part shall not apply to the licensing of any of the
10 following facilities or persons and shall not be construed as requiring any of the
11 following facilities or persons to seek licensure as a behavioral health services
12 provider:

14 (12) School-based health clinics and centers that are certified by the
15 Louisiana Department of Health, office of public health, and enrolled in the
16 Louisiana Medicaid program and an individual providing school-based health
17 services through a public school governing authority who meets both the following
18 criteria:

1 (a) He is a school psychologist certified by the state Department of
2 Education pursuant to R.S. 17:7.1(D) or a social worker licensed by the Louisiana
3 State Board of Social Work Examiners pursuant to R.S. 37:2707.
4 (b) He is enrolled in the Louisiana Medicaid program under the Early and
5 Periodic Screening, Diagnostic, and Treatment program.

Abstract: Adds certain school-based psychologists and social workers to those providers
exempt from behavioral health provider licensing requirements.
Present law, the Behavioral Health Services Provider Licensing Law, authorizes the La.
Dept. of Health (LDH) to provide for the health, safety, and welfare of persons receiving
behavioral health services through the licensure and regulation of behavioral health services
providers. Exempts certain types of providers from the requirement for licensure, including
school-based health clinics and centers that are certified by LDH, office of public health, and
enrolled in the La. Medicaid program.
Proposed law retains present law and also exempts from behavioral health services licensure
requirements an individual who provides school-based health services through a public
school governing authority and who meets both the following criteria:
(1)He is a certified school psychologist or a licensed master's social worker.
(2)He is enrolled in the La. Medicaid program under the Early and Periodic Screening,
Diagnostic, and Treatment program.
