HOUSE BILL NO. 392
BY REPRESENTATIVE HENRY
1	AN ACT
2 To appropriate funds  and to make certain reductions from certain sources to be allocated to
3 designated agencies and purposes in specific amounts for the making of
4 supplemental appropriations and reductions for said agencies and purposes for Fiscal
5 Year 2018-2019; to provide for an effective date; and to provide for related matters.
6 Be it enacted by the Legislature of Louisiana:
7 Section 1.  The following sums are hereby appropriated from the sources specified for
8 the purpose of making supplemental appropriations for Fiscal Year 2018-2019. Reductions
9 are denoted in parentheses.

12 the Swanson Center for Youth and the Swanson Center for Youth at Columbia in the
13 personal services and interagency transfers expenditure categories.
14 The commissioner of administration is hereby authorized and directed to adjust the means
15 of finance for the Central/Southwest Region Program, as contained in Act No. 2 of the 2018
16 Third Extraordinary Session of the Legislature, by reducing the appropriation out of the State
17 General Fund (Direct) by ($475,000) to realign budget authority with the actual expenditures
18 for the Acadiana Center for Youth in the categories of travel, operating services, acquisitions,
19 and interagency transfers.
20 The commissioner of administration is hereby authorized and directed to adjust the means
21 of finance for the Contract Services Program, as contained in Act No. 2 of the 2018 Third
22 Extraordinary Session of the Legislature, by reducing the appropriation out of the State
23 General Fund (Direct) by ($2,300,000) to realign budget authority with the actual
24 expenditures related to contractual obligations with community-based service providers.

1 Provided, however, that of the total appropriated herein for rate restorations and enhancing
2 reimbursements, the department shall allocate the funding in such a manner to maximize the
3 payments to each provider group to the greatest extent possible.  Provided, further,
4 notwithstanding any provision of law to the contrary, this appropriation shall be deemed a
5 bona fide obligation through June 30, 2019.

2 judgments against the state, and claims against the state for erroneous payments of corporate
3 franchise tax, all as provided in this Section.  A judgment may only be paid from this
4 appropriation if it is final.  All judgments provided for in this Section shall be paid as to
5 principal, interest, court costs, and expert witness fees as awarded in each judgment, it being
6 the intent herein that when the provisions of a judgment conflict with the provisions of this
7 Act, the provisions of the judgment shall be controlling.  Any other provision of this Act not
8 in conflict with the provisions of a judgment shall control.  Payment shall be made as to each
9 judgment or final judgment only after presentation to the state treasurer of documentation
10 required by the state treasurer.  Further, all judgments provided for in this Section shall be
11 deemed to have been paid on the effective date of the Act, and interest shall cease to run as
12 of that date.  A claim against the state for erroneous payments of corporate franchise tax may
13 only be paid from this appropriation if it is final.  All claims for erroneous payments of
14 corporate franchise tax provided for in this Section shall be paid as to principal and interest
15 as awarded in each recommendation from the Board of Tax Appeals, it being the intent
16 herein that when the provisions of a recommendation conflict with the provisions of this Act,
17 the provisions of the recommendation shall be controlling. Payment shall be made as to each
18 recommendation only after presentation to the state treasurer of documentation required by
19 the state treasurer.  Further, all recommendations provided for in this Section shall be
20 deemed to have been paid on the effective date of the Act, and interest shall cease to run as
21 of that date.

17 signed by the governor, upon expiration of the time for bills to become law without signature
18 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana.  If
19 vetoed by the governor and subsequently approved by the legislature, this Act shall become
20 effective on the day following such approval.
