HLS 19RS-27 ORIGINAL 2019 Regular Session HOUSE BILL NO. 44 BY REPRESENTATIVE BAGLEY NOTARIES: Provides for ex officio notaries public with certain limited authority for the DeSoto Parish Police Jury 1 AN ACT 2To enact R.S. 35:417, relative to ex officio notaries public for the DeSoto Parish 3 government; to authorize the president of the DeSoto Parish Police Jury to designate 4 up to two employees within his office as ex officio notaries public; to provide for 5 duties and functions of the ex officio notaries public; to provide for limitations and 6 termination of the ex officio notaries public; and to provide for related matters. 7 Notice of intention to introduce this Act has been published 8 as provided by Article III, Section 13 of the Constitution of 9 Louisiana. 10Be it enacted by the Legislature of Louisiana: 11 Section 1. R.S. 35:417 is hereby enacted to read as follows: 12 ยง417. Ex officio notaries public for the DeSoto Parish government 13 A. Notwithstanding any provisions of the law relative to qualifications of 14 notaries public, the president of the DeSoto Parish Police Jury may designate no 15 more than two employees in his office and appoint them as ex officio notaries public. 16 B. Each employee so appointed as ex officio notary public may exercise, 17 within his respective jurisdictional limits, the functions of a notary public only to 18 administer oaths, receive sworn statements, and execute affidavits and 19 acknowledgments, all limited to matters within the official functions of the office of 20 the DeSoto Parish Police Jury. All acts performed by each ex officio notary public authorized by this 2 Section shall be performed without charge or other compensation and without the 3 necessity of giving bond. 4 D. The president of the police jury may suspend or terminate an appointment 5 made in his office pursuant to this Section at any time, and a separation from the 6 employ of the parish shall automatically terminate the former employee's 7 appointment as an ex officio notary public.
