HOUSE BILL NO. 557

PHARMACISTS:  Provides relative to pharmacy reimbursement
1	AN ACT
2To amend and reenact R.S. 22:1857, relative to reimbursement paid under certain contracts
3 to pharmacists and pharmacies; to provide relative to items for which reimbursement
4 is paid; and to provide for related matters.
5Be it enacted by the Legislature of Louisiana:
6 Section 1.  R.S. 22:1857 is hereby amended and reenacted to read as follows:
7 ยง1857.  Prescription drugs, devices, products, and supplies; use of index
8	A.  Reimbursement under a contract to a pharmacist or pharmacy for
9 prescription drugs, devices, and other products and supplies that is calculated
10 according to a formula that uses a nationally recognized reference in the pricing
11 calculation shall use the most current nationally recognized reference price or
12 amount in the actual or constructive possession of the health insurance issuer, its
13 agent, or any other party responsible for reimbursement for prescription drugs,
14 devices, and other products and supplies on the date of service shown on the claim.
15	B.  Health insurance issuers, their agents, and other parties responsible for
16 reimbursement for prescription drugs, devices, and other products and supplies shall
17 be required to update the nationally recognized reference prices or amounts used for
18 calculation of reimbursement for prescription drugs, devices, and other products and
19 supplies no less than every three business days.

1	C.  Any health insurance issuer, agent, or other party responsible for
2 reimbursement for prescription drugs, devices, and other products and supplies that
3 does not comply with the requirements of Subsection A or B of this Section shall be
4 subject to the late payment adjustment provisions of R.S. 22:1854(C) to the extent
5 of any amount not paid in accordance with the requirements of this Section.
