AGRICULTURE/FOREST DEPT: Provides relative to the membership and voting
requirements of the Louisiana Agricultural Commodities Commission
1 AN ACT
2To amend and reenact R.S. 3:3403(C) and (H), relative to the Louisiana Agricultural
3 Commodities Commission; to provide for membership and voting requirements; and
4 to provide for related matters.
5Be it enacted by the Legislature of Louisiana:
6 Section 1. R.S. 3:3403(C) and (H) are hereby amended and reenacted to read as
7follows:
8 ยง3403. Louisiana Agricultural Commodities Commission; creation; membership;
9 terms; panels of nominees; filling of vacancies; oaths of office; per diem;
10 quorum; domicile; meetings; successor to State Warehouse Commission

12 C. The tenth member shall be the commissioner of agriculture and forestry
13 or his designee, who shall serve ex officio, but with all of the powers, rights, duties,
14 and privileges as appointed members, including the right to vote on all matters
15 before the commission.

17 H. Five members shall constitute a quorum for the transaction of official
18 business. All official actions of the commission shall require the affirmative a
19 majority vote of five the members of the commission present and voting.

Abstract: Authorizes a designee of the commissioner of agriculture and forestry to serve
on the La. Agricultural Commodities Commission and changes the voting
requirements for the commission.
Present law provides that the commissioner of agriculture and forestry is an ex officio
member of the La. Agricultural Commodities Commission.
Proposed law authorizes a designee of the commissioner to serve in place of the
commissioner.
Present law requires the affirmative vote of five members of the commission to take official
actions.
Proposed law changes the requirement to a majority vote of members that are present and
voting.
