SUPPLEMENTAL PAY: Increases the amount of supplemental pay for eligible law enforcement and fire protection officers 1 AN ACT 2To amend and reenact R.S. 40:1666.1(A)(1) and (4)(a), 1667.1(A)(1) and (2)(a), 1667.7(B) 3 and (G), and 1667.9; relative to supplemental pay; to increase supplemental pay for 4 eligible law enforcement officers and firefighters; to provide for an effective date; 5 and to provide for related matters. 6Be it enacted by the Legislature of Louisiana: 7 Section 1. R.S. 40:1666.1(A)(1) and (4)(a), 1667.1(A)(1) and (2)(a), 1667.7(B) and 8(G), and 1667.9 are hereby amended and reenacted to read as follows: 9 §1666.1. Extra compensation 10 A.(1) In addition to the compensation now paid by any municipality, parish, 11 fire protection district, or other political subdivision maintaining a fire department, 12 or by the Chitimacha Tribe of Louisiana or the Coushatta Tribe of Louisiana, 13 hereinafter referred to as "tribe", or by any nonprofit corporation contracting with 14 any such political subdivision to provide fire protection services to every paid, 15 regularly employed employee who is paid not less than three hundred dollars per 16 month, not including supplemental pay, as distinguished from part-time employees 17 and volunteers of such fire department, who are carried on the payroll of such fire 18 department, and every employee as defined herein who is paid from funds of the 19 parish or municipality or tribe obtained through lawfully adopted bond issues, 20 lawfully assessed taxes, or other funds available for such purpose, either directly or Page 1 of 5 CODING: Words in struck through type are deletions from existing law; words underscored are additions. HLS 19RS-429 ORIGINAL HB NO. 93 1 through a board or commission set up by law or ordinance of the parish or 2 municipality or tribe, shall be paid extra compensation by the state in the amount of 3 five seven hundred fifty dollars per month for each such paid employee who has 4 completed or who hereafter completes one year of service. The provisions of 5 Paragraph (5) of this Subsection shall govern the requirements for length of service 6 for employees who were ordered to active miliary duty in the armed services of the 7 United States during their initial term of employment. 8 * * * 9 (4)(a) Every fire protection officer who is employed on a full-time basis by 10 a port authority headquartered in the city of New Orleans shall be paid by the state 11 extra compensation in the amount of five seven hundred fifty dollars per month in 12 addition to the compensation now paid to him by his employer out of self-generated 13 revenue attributable to the agency employing such fire protection officers. To be 14 eligible for the extra compensation, each such fire protection officer shall have 15 completed one year of service, and any such fire protection officer hired after March 16 31, 1986, shall also have completed and passed a certified fireman's training program 17 equal to National Fire Protection Association Standard 1001 Firefighter I 18 Certification or a firemen's training program as approved by the Louisiana State 19 University Firemen Training Program in accordance with R.S. 40:1541 et seq., or 20 other state or federally approved maritime firefighter training program. 21 * * * 22 §1667.1. Rate of compensation; prior service; supplemental monthly compensation; 23 police to receive additional compensation 24 A.(1) In addition to the compensation now paid by any municipality included 25 in this Part or by the Chitimacha Tribe of Louisiana, the Coushatta Tribe of 26 Louisiana, or the Tunica-Biloxi Tribe of Louisiana, hereinafter referred to as "tribe" 27 or "tribal", to any police officer, every police officer employed by any municipality 28 or tribe which employs one or more police officers who devotes his full working 29 time to law enforcement, and for those hired after March 31, 1986, who have Page 2 of 5 CODING: Words in struck through type are deletions from existing law; words underscored are additions. HLS 19RS-429 ORIGINAL HB NO. 93 1 completed and passed a council-certified training program as provided in R.S. 2 40:2405, shall be paid by the state extra compensation in the amount of five seven 3 hundred fifty dollars per month for each full-time municipal or tribal law 4 enforcement officer who has completed or who hereafter completes one year of 5 service. 6 (2)(a) Every sworn, commissioned law enforcement officer employed on a 7 full-time basis by a bona fide police agency of the state or its political subdivisions, 8 other than the Department of Public Safety and Corrections and the Department of 9 Wildlife and Fisheries, and headquartered in the city of New Orleans and who serves 10 the welfare of the public in the capacity of a police officer by providing police 11 services to the general public through effecting arrests, issuing citations, and serving 12 warrants while patrolling levees, waterways, and riverfront areas, or while patrolling 13 bridges that are within the boundaries of the city of New Orleans, shall be paid by 14 the state extra compensation in the amount of five seven hundred fifty dollars per 15 month in addition to the compensation now paid to him by his employer out of self- 16 generated revenue attributable to the agency employing such officers. To be eligible 17 for the extra compensation, each such law enforcement officer shall have completed 18 one year of service, and any such law enforcement officer hired after March 31, 19 1986, shall also have completed and passed a council-certified training program, as 20 provided in R.S. 40:2405. 21 * * * 22 §1667.7. Extra compensation for commissioned full-time deputy sheriffs of all 23 parishes 24 * * * 25 B. Out of the funds appropriated by the legislature for the payment of the 26 extra compensation provided by Subsection A of this Section, there shall be 27 distributed to the sheriff of each parish monthly to pay additional compensation for 28 full-time commissioned deputy sheriffs, and for those hired after March 31, 1986, 29 who have completed and passed a council-approved training program as provided Page 3 of 5 CODING: Words in struck through type are deletions from existing law; words underscored are additions. HLS 19RS-429 ORIGINAL HB NO. 93 1 in R.S. 40:2405 and who are paid a salary of not less than three hundred fifty dollars 2 per month, the amount of five seven hundred fifty dollars per month for each 3 full-time commissioned deputy sheriff at the completion of one year of service. 4 * * * 5 G. Notwithstanding the provisions of Subsections A and B of this Section, 6 any full-time deputy sheriff employed as a field representative or process server and 7 who is paid a salary of not less than three hundred fifty dollars per month shall be 8 entitled to receive extra compensation in the amount of five seven hundred fifty 9 dollars per month at the completion of one year of service. However, to be eligible 10 for such extra compensation, a field representative or process server shall have 11 completed and passed a council-approved training program as provided in R.S. 12 40:2405. 13 * * * 14 §1667.9. Extra compensation for commissioned full-time harbor police, fireboat 15 personnel, and bridge police 16 In addition to the compensation now paid to any harbor police officer, 17 fireboat operator, and bridge police officer, every harbor police officer, fireboat 18 employee, and bridge police officer who is a full-time employee and who is paid a 19 salary of not less than eight hundred dollars per month and who has completed and 20 passed a post-certified training program as provided in R.S. 40:2405 and who has 21 completed or who hereafter completes one year of service shall be paid by the state 22 extra compensation in the amount of five seven hundred fifty dollars per month. The 23 provisions of this Section shall only apply to employees of a political subdivision of 24 the state. 25 Section 2. This Act shall become effective on July 1, 2019; if vetoed by the governor 26and subsequently approved by the legislature, this act shall become effective on July 1, 2019, 27or on the day following such approval by the legislature, whichever is later. Also provides supplemental pay of $500 per month for certain full-time firefighters with the New Orleans port authority. Proposed law increases the supplemental pay from $500 per month to $750 per month for eligible firefighters. Present law provides for supplemental pay of $500 per month for any police officer paid by any municipality or by the Chitimacha Tribe of La., Coushatta Tribe of La., or the Tunica- Biloxi Tribe of La., who devotes his full working time to law enforcement and has passed a council-certified training program and has completed one year of service. Also includes certain police officers providing services while patrolling levees, waterways, riverfront areas, and bridges within the city of New Orleans. Proposed law increases the supplemental pay from $500 per month to $750 per month for eligible police officers. Present law provides for supplemental pay of $500 per month to any sheriff for the payment of any full-time commissioned deputy sheriff who has passed a council-approved training program and who is paid a salary of not less than $350 per month and has completed one year of service. Also includes a full-time deputy sheriff employed as a field representative or process server. Proposed law increases the supplemental pay from $500 per month to $750 per month for eligible sheriff deputies. Present law provides for supplemental pay of $500 per month paid to any harbor and bridge police officer or fireboat operator who is a full-time employee and has passed a post- certified training program and who is paid a salary of not less than $800 per month and has completed one year of service. This shall only apply to employees of a political subdivision of the state. Proposed law increases the supplemental pay from $500 per month to $750 per month for eligible police officers. Effective July 1, 2019.
