HLS 19RS-2504 ORIGINAL 2019 Regular Session HOUSE CONCURRENT RESOL UTION NO. 104 BY REPRESENTATIVE IVEY LEGISLATIVE AFFAIRS: Creates a joint committee to study the information technology systems used by legislative agencies 1 A CONCURRENT RESOL UTION 2To create and provide with respect to a joint legislative committee to conduct a 3 comprehensive and detailed analysis of information technology systems used by the 4 agencies of the legislative branch of state government and to report its findings and 5 recommendations to the legislature by January 13, 2020. 6 WHEREAS, information technology systems, including the management and 7technical development of these systems, are essential for legislative agencies to perform the 8functions of the legislative branch of state government; and 9 WHEREAS, the information processed and stored in its information technology 10systems is an important asset and responsibility of the legislature; and 11 WHEREAS, information technology, both hardware and software, evolves very 12quickly and keeping it up to date may require significant funding for an enterprise as large 13as the legislative branch of state government, but failing to do so can also become a drain 14on the state fisc due to inefficiencies caused by slow or incompatible systems, social and 15economic costs of failures in older technology, and exposure to malicious attacks to which 16older technology is more vulnerable; and 17 WHEREAS, interruption in the availability of information technology systems and 18services presents a risk to the continuity of the work of the legislative branch of state 19government; and 20 WHEREAS, the information technology systems and services of legislative agencies 21should incorporate the most effective technology available to ensure continuity of Page 1 of 3 HLS 19RS-2504 ORIGINAL HCR NO. 104 1operations, protection of information, long-term cost savings through efficiency, and 2availability of information to citizens of the state. 3 THEREFORE, BE IT RESOLVED that the Legislature of Louisiana does hereby 4create a special joint legislative committee, composed of six members as hereinafter 5provided, to conduct a comprehensive and detailed analysis of information technology 6systems used by the agencies of the legislative branch of state government. 7 BE IT FURTHER RESOLVED that the joint committee shall be composed of three 8members of the House of Representatives appointed by the speaker of the House of 9Representatives and three members of the Senate appointed by the president of the Senate. 10 BE IT FURTHER RESOLVED that the speaker of the House of Representatives and 11the president of the Senate shall appoint the members of the joint committee no later than 12thirty days after adoption of this Resolution. 13 BE IT FURTHER RESOLVED that a member of the joint committee designated by 14the speaker of the House of Representatives shall call the first meeting of the joint committee 15no later than ten days after all of the members of the joint committee are appointed and shall 16preside until the joint committee selects a chairman and a vice chairman. 17 BE IT FURTHER RESOLVED that any member of the joint committee may 18examine an information technology system of a legislative agency and make inquiries of any 19employee or contractor of a legislative agency concerning such system, or designate one or 20more staff members of the joint committee to do so, in conducting the business of the joint 21committee. 22 BE IT FURTHER RESOLVED that the joint committee shall report its findings and 23recommendations by January 13, 2020. 24 BE IT FURTHER RESOLVED that the report of the joint committee shall include 25at a minimum the following information: 26 (1) A detailed description of each information technology system used by the 27agencies in the legislative branch of state government, including without limitation the 28estimated useful life of software and hardware included in the system and requirements to 29support the system. Page 2 of 3 HLS 19RS-2504 ORIGINAL HCR NO. 104 1 (2) Identification of systems that are inefficient, recommendations for improvements 2of such inefficient systems, and potential costs and cost savings of such improvements. 3 (3) Identification of points of risk of failure of aging systems, estimates of the social 4and economic impacts of any such failure, and potential costs and risk reductions gained by 5updating such systems. 6 (4) Identification of risk of unauthorized access, loss or corruption of data, and 7exposure to malicious software, the severity of such risks, estimates of the social and 8economic impacts of any such attack, and potential costs and risk reductions gained by 9updating such systems. 10 (5) Identification of sources of revenue that are dedicated to technology needs of 11legislative agencies. 12 (6) Recommended priorities for upgrades considering all such costs, liabilities, and 13benefits. 14 BE IT FURTHER RESOLVED that the report of the joint committee shall include 15findings for each agency within the legislative branch of state government and findings that 16are not agency-specific. 17 BE IT FURTHER RESOLVED that the report of the joint committee shall be 18delivered to the legislature in accordance with R.S. 24:772 except that information in the 19report that would be exempt from disclosure pursuant to R.S. 44:3.1 or another provision of 20the Public Records Law shall be excised from the report submitted to the legislature and 21delivered in a separate report to the House Select Committee on Homeland Security and the 22Senate Select Committee on Homeland Security meeting, jointly or separately, in executive 23session.
