HLS 19RS-1463 ENGROSSED 2019 Regular Session HOUSE CONCURRENT RESOL UTION NO. 48 BY REPRESENTATIVE FOIL HEALTH CARE/FACILITIES: Requests a study concerning the potential use of monitoring devices in the rooms of residents of intermediate care facilities for people with developmental disabilities 1 A CONCURRENT RESOL UTION 2To urge and request the Louisiana Department of Health to study the feasibility and 3 desirability of implementing a policy to allow the use of monitoring devices in the 4 rooms of residents of intermediate care facilities for people with developmental 5 disabilities, and to report findings of the study to the legislative committees on health 6 and welfare. 7 WHEREAS, intermediate care facilities for people with developmental disabilities, 8referred to hereafter as "ICF/DD", are facilities that provide services to individuals with 9developmental or intellectual disabilities who require twenty-four hours of care per day in 10community, group, or residential home settings; and 11 WHEREAS, ICF/DDs are licensed and regulated by the Louisiana Department of 12Health in accordance with the provisions of R.S. 40:2180 et seq.; and 13 WHEREAS, ensuring the health and safety of ICF/DD residents is a vitally important 14duty of this state; and 15 WHEREAS, Louisiana law, R.S. 40:1193.1 et seq., authorizes the use of monitoring 16devices, subject to certain conditions and requirements, in the rooms of residents of other 17types of institutional facilities in which vulnerable populations receive care; however, the 18use of such devices in the ICF/DDs of this state is not yet authorized in statute or rule. 19 THEREFORE, BE IT RESOLVED that the Legislature of Louisiana does hereby 20urge and request the Louisiana Department of Health to study the feasibility and desirability Page 1 of 2 HLS 19RS-1463 ENGROSSED HCR NO. 48 1of implementing a policy to allow the use of monitoring devices in the rooms of residents 2of intermediate care facilities for people with developmental disabilities. 3 BE IT FURTHER RESOLVED that in developing the study called for in this 4Resolution, the department shall engage, collaborate with, and obtain information and 5perspective from stakeholder organizations including, without limitation, the governor's 6office of disability affairs and the Louisiana Developmental Disabilities Council. 7 BE IT FURTHER RESOLVED that the department shall submit a written report of 8its findings resulting from the study requested in this Resolution to the House Committee 9on Health and Welfare and the Senate Committee on Health and Welfare on or before March 1031, 2020. 11 BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to the 12secretary of the Louisiana Department of Health, the executive director of the governor's 13office of disability affairs, and the executive director of the Louisiana Developmental 14Disabilities Council.
