MOTOR VEHICLES:  Creates the Wireless Telecommunications and Vehicle Safety Study
Commission to study the use of a wireless telecommunications device while
operating a motor vehicle
1	A RESOLUTION
2To create and establish the Wireless Telecommunications and Vehicle Safety Study
3 Commission to study the use of a wireless telecommunications device while
4 operating a motor vehicle.
5 WHEREAS, the use of wireless telecommunications devices while operating a motor
6vehicle is becoming an epidemic within the state of Louisiana; and
7 WHEREAS, using a wireless telecommunications device while operating a vehicle
8is one of the top distractions for drivers traversing the roadways throughout the country; and
9 WHEREAS, a person cannot travel on any road within this state without noticing
10someone using a wireless telecommunications device while operating a motor vehicle; and
11 WHEREAS, numerous accidents, including fatalities, have occurred due to people
12being distracted while driving using their wireless telecommunications device while
13operating a motor vehicle; and
14 WHEREAS, House Bill No. 229 of the 2019 Regular Session proposed regulating
15the use of a wireless telecommunications device while operating a motor vehicle; and
16 WHEREAS, if enacted, House Bill No. 229 would have provided for changes and
17additions to current provisions of law regulating the use of a wireless telecommunications
18device while operating a motor vehicle; and

1 WHEREAS, further inquiry and investigation is necessary to fully develop the
2necessary changes and addition to current provisions regulating the use of a wireless
3telecommunications device while operating a motor vehicle.
4 THEREFORE, BE IT RESOLVED that the House of Representatives of the
5Legislature of Louisiana does hereby create the Wireless Telecommunications and Vehicle
6Safety Study Commission to study the use of a wireless telecommunications device while
7operating a motor vehicle and provide recommendations for changes and additions to current
8provisions of law regulating the use of a wireless telecommunications device while operating
9a motor vehicle.
10 BE IT FURTHER RESOLVED that the study commission shall be composed of the
11following members:
12 (1)  The secretary of the Department of Public Safety and Corrections or his
13designee.
14 (2)  A representative of the Department of Public Safety and Corrections, office of
15state police as appointed by the superintendent.
16 (3)  The president of the Louisiana Sheriffs' Association or his designee.
17 (4)  The president of the Louisiana Association of Chiefs of Police or his designee.
18 (5)  The chief executive officer of StopDistractions.org or his designee.
19 BE IT FURTHER RESOLVED, at a minimum, the commission shall study the
20following:
21 (1)  The magnitude of the problem.
22 (2)  Crash types involving the use of a wireless telecommunications device while
23operating a motor vehicle, whether fatal or non-fatal, single vehicle or multiple vehicle, and
24the age of the people or person involved.
25 (3)  Contrast crash types involving the use of a wireless telecommunications device
26while driving as opposed to crash types that do not involve the use of a wireless
27telecommunications device while driving.
28 (4)  Strategies that have the potential for reducing the use of a wireless
29telecommunications device while operating a motor vehicle.

1 BE IT FURTHER RESOLVED that the study commission shall submit a report
2detailing the results of its study, along with its recommendations, to the legislature prior to
3February 1, 2020.
4 BE IT FURTHER RESOLVED that the Wireless Telecommunication and Vehicle
5Safety Study Commission shall cease on February 28, 2020.
6 BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to the
7secretary of the Department of Public Safety and Corrections, the superintendent of the
8Department of Public Safety and Corrections, office of state police, the president of the
9Louisiana Sheriffs' Association, the president of the Louisiana Association of Chiefs of
10Police, and the chief executive officer of StopDistractions.org.

Provides that the commission be comprised of the following:  the secretary of the Dept. of
Public Safety and Corrections or his designee, a representative of the Dept. of Public Safety
and Corrections, office of state police, as designated by the superintendent, the president of
the Louisiana Sheriffs' Association or his designee, the president of the Louisiana
Association of Chiefs of Police or his designee, and the chief executive officer of
StopDistractions.org or his designee.
Requires the commission study the following:  the magnitude of the problem; crash types
involving the use of a wireless telecommunications device while operating a motor vehicle,
whether fatal or non-fatal, single vehicle or multiple vehicle, and the age of the people or
person involved; contrast crash types involving the use of a wireless telecommunications
device while driving as opposed to crash types that do not involve the use of a wireless
telecommunications device while driving; and strategies that have the potential for reducing
the use of a wireless telecommunications device while operating a motor vehicle.
Requires the commission to submit a report detailing the results of its study and its
recommendations to the legislature prior to Feb. 1, 2020.
