SENATE BILL NO. 104

SPECIAL DISTRICTS.  Provides for an increase of commissioners to the board of Gravity
Drainage District No. 5 of Livingston Parish. (gov sig)
1	AN ACT
2 To amend and reenact R.S. 38:1759(B), relative to the board of commissioners of Gravity
3 Drainage District No. 5 of Livingston Parish; to increase the membership of the
4 board of commissioners; and to provide for related matters.
5	Notice of intention to introduce this Act has been published.
6 Be it enacted by the Legislature of Louisiana:
7 Section 1.  R.S. 38:1759(B) is hereby amended and reenacted to read as follows:
8 ยง1759.  Appointment and terms of commissioners

10	B. Notwithstanding the provisions of Subsection A of this Section, the board
11 of commissioners of Gravity Drainage District No. 2 and Gravity Drainage District
12 No. 5 of Livingston Parish shall consist of seven members, subject to all other
13 requirements of qualifications for office provided in Subsection A of this Section.
14 Section 2.  This Act shall become effective upon signature by the governor or, if not
15 signed by the governor, upon expiration of the time for bills to become law without signature
16 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If
17 vetoed by the governor and subsequently approved by the legislature, this Act shall become

1 effective on the day following such approval.

Present law authorizes the police jury organizing the drainage district to appoint five
commissioners in each district.
Present law provides as an exception that the governing authority of Livingston Parish shall
appoint seven commissioners for Gravity Drainage District No. 2.
Proposed law requires the governing authority of Livingston Parish to increase the number
of board commissioners from five to seven for Gravity Drainage District No. 5.
Effective upon signature of the governor or lapse of time for gubernatorial action.
