ALCOHOLIC BEVERAGES. Provides relative to the definition of liquor retail distribution

AN ACT1
2 To amend and reenact R.S. 26:2(9), relative to Alcoholic Beverage Control Law; to provide
3 relative to the definition of liquor retail distribution center; and to provide for related
4 matters.
5 Be it enacted by the Legislature of Louisiana:
6 Section 1. R.S. 26:2(9) is hereby amended and reenacted to read as follows:
7 ยง2. Definitions
8 For purposes of this Chapter, the following terms have the respective
9 meanings ascribed to them in this Section, unless a different meaning clearly appears
10 from the context:

12 (9) "Liquor retail distribution center" means any liquor retailer who has
13 continuously maintained a distribution center or centers for distribution to its
14 wholly owned retail permittees on or prior to January 1, 1961, in this state, or
15 any commercial airline that stores alcoholic beverages in sealed containers of any
16 size at any airport regularly served by the permittee. Such possession for retail sale
17 or distribution therefrom shall be limited to alcohol of high volume content in any
18 quantity.

Present law, regarding Alcoholic Beverage Control Law, provides a three-tier system for
distribution of alcoholic beverages and mandates separation between the tiers. The first tier
consists of producers, manufacturers, and suppliers; the second tier consists of distributors
and wholesalers; and the third tier consists of retailers. With few exceptions, only retailers
(supermarkets, liquor stores, bars, restaurants, hotels, etc.) may sell to consumers.
Present law defines "liquor retail distribution center" as an commercial airline that stores
alcoholic beverages in sealed containers of any size at any airport regularly served by the
permittee. Provides that possession for retail sale or distribution therefrom shall be limited
to alcohol of high volume content in any quantity.
Proposed law retains present law and adds to the definition any liquor retailer who has
continuously maintained a distribution center or centers for distribution to its wholly owned
retail permittees on or prior to January 1, 1961, in Louisiana. Proposed law restores language
deleted by Act No. 449 of the 2018 Regular Session.
Effective August 1, 2019.
