(gov sig) 1 AN ACT 2 To amend and reenact R.S. 49:214.5.1, relative to the Coastal Protection and Restoration 3 Authority Board; to provide for its membership; to provide for qualification of 4 designees; to add a member; and to provide for related matters. 5 Be it enacted by the Legislature of Louisiana: 6 Section 1. R.S. 49:214.5.1 is hereby amended and reenacted to read as follows: 7 ยง214.5.1. Coastal Protection and Restoration Authority Board 8 A. The Coastal Protection and Restoration Authority Board is hereby created 9 within the office of the governor. The board is hereby established, and shall exercise 10 the powers and duties hereinafter set forth or otherwise provided by law. The 11 provisions of R.S. 44:5(A) shall not be applicable to any activities or records of or 12 pertaining to the authority. 13 B. The Coastal Protection and Restoration Authority Board shall consist of 14 the following members: 15 (1) Executive assistant to the governor for coastal activities. 16 (2) Secretary of the Department of Natural Resources or his designee who is 17 an employee of the department. SB NO. 190 SLS 19RS-143 REENGROSSED 1 (3) Secretary of the Department of Wildlife and Fisheries or his designee who 2 is an employee of the department. 3 (4) Secretary of the Department of Environmental Quality or his designee 4 who is an employee of the department. 5 (5) Secretary of the Department of Transportation and Development or his 6 designee who is an employee of the department. 7 (6) Secretary of the Department of Economic Development or his designee 8 who is an employee of the department. 9 (7) Commissioner of administration or his designee who is an employee of 10 the division. 11 (8) Commissioner of agriculture and forestry or his designee who is an 12 employee of the department. 13 (9) Commissioner of insurance or his designee who is an employee of the 14 department. 15 (10) Seven members who shall be appointed by the governor, in consultation 16 with the Police Jury Association of Louisiana and the Association of Levee Boards 17 of Louisiana, from nominations submitted by levee districts located in whole or in 18 part in the coastal area, from legislators who represent districts in whole or in part 19 in the coastal area, and from parish governing authorities located in whole or in part 20 in the coastal area. The appointees shall be residents of the coastal area and shall be 21 appointed on a proportional basis in such a manner as to reflect the population and 22 land area of the parishes located in whole or in part in the coastal area. However, 23 there shall be at least two appointees who reside in the area of the coastal area 24 located west of the Atchafalaya River and at least two appointees who reside in the 25 area of the coastal area located east of the Atchafalaya River. 26 (11) The chair of the Governor's Advisory Commission on Coastal 27 Protection, Restoration, and Conservation or his designee who is a member of the 28 commission. 29 (12) The director of the Governor's Office of Homeland Security and Page 2 of 4 Coding: Words which are struck through are deletions from existing law; words in boldface type and underscored are additions. SB NO. 190 SLS 19RS-143 REENGROSSED 1 Emergency Preparedness or his designee who is an employee of the office. 2 (13) The speaker of the House of Representatives, or his designee, who is a 3 member of the House of Representatives and shall serve as an ex officio member 4 who shall not have the authority to vote and who shall not be counted for purposes 5 of a quorum. 6 (14) The president of the Senate, or his designee, who is a member of the 7 Senate and who shall serve as an ex officio member who shall not have the authority 8 to vote and who shall not be counted for purposes of a quorum. 9 (15) The lieutenant governor or his designee who is an employee of the 10 office of lieutenant governor. 11 C. Any member of the board who represents a political subdivision shall 12 recuse himself from deliberations and from voting on any matter concerning the 13 taking of action against that political subdivision for lack of compliance with the 14 plan. 15 C. D. The executive assistant shall serve as chairman and shall develop 16 procedures for the operation of the board. 17 Section 2. This Act shall become effective upon signature by the governor or, if not 18 signed by the governor, upon expiration of the time for bills to become law without signature 19 by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. If 20 vetoed by the governor and subsequently approved by the legislature, this Act shall become 21 effective on the day following such approval. DIGEST SB 190 Reengrossed 2019 Regular Session Chabert Present law provides for the Coastal Protection and Restoration Authority Board to be composed of the leadership of various state agencies, departments, commissions of the executive, and legislative branches of state government or their designees. Proposed law retains present law and requires the designees to be employees of the respective state agency, department, or commission, or be members of the respective legislative entity. (Amends R.S. 49:214.5.1) Summary of Amendments Adopted by Senate Senate Floor Amendments to engrossed bill 1. Retains ex officio status (no authority to vote and attendance does not count towards a quorum) of both the House of Representative and Senate members. 2.
