CONTROL DANGER SUBSTANCE.  Provides relative to the provision of medication-
assisted treatment (MAT). (8/1/19)
1	AN ACT
2 To enact R.S. 37:913(3)(c) and 1360.31(C)(4), relative to the provision of
3 medication-assisted treatment (MAT); to provide authority for advanced practice
4 registered nurses and physician assistants to provide MAT; to provide for
5 compliance with federal law and state rules relative to MAT; to provide for
6 minimum requirements for collaborating or supervising physicians; and to provide
7 for related matters.
8 Be it enacted by the Legislature of Louisiana:
9 Section 1.  R.S. 37:913(3)(c) and 1360.31(C)(4) are hereby enacted to read as
10 follows:

1 Department of Health and Human Services, Substance Abuse and Mental
2 Health Services Administration and in accordance with rules promulgated by
3 the board. At a minimum, rules promulgated by the board shall include a
4 requirement that in order for the APRN to provide MAT, his collaborating
5 physician shall also be authorized and in compliance with all federal and state
6 laws and rules authorizing the provision of MAT. For purposes of this
7 Subparagraph, "MAT" means the use of medications with counseling and
8 behavioral therapies to treat substance use disorders and prevent opioid
9 overdose.

15	(4) A physician assistant may provide medication-assisted treatment
16 (MAT), as authorized by the United States Department of Health and Human
17 Services, Substance Abuse and Mental Health Services Administration and in
18 accordance with rules promulgated by the board. At a minimum, rules
19 promulgated by the board shall include a requirement that in order for the PA
20 to provide MAT, his supervising physician shall also be authorized and in
21 compliance with all federal and state laws and rules authorizing the provision
22 of MAT. For purposes of this Subparagraph, "MAT" means the use of
23 medications with counseling and behavioral therapies to treat substance use
24 disorders and prevent opioid overdose.

Present law provides for scope of practice and regulation of advanced practice registered
nurses (APRNs) and physician assistants (PAs). Proposed law provides that APRNs and PAs
may provide medication-assisted treatment in accordance with federal and state laws and
state rules governing MAT services. 
Proposed law provides that, at a minimum, state rules shall require the APRN's collaborating
physician and the PA's supervising physician to be authorized and in compliance with all
federal and state laws and rules authorizing the provision of MAT. 
Proposed law defines MAT as the use of medications with counseling and behavioral
therapies to treat substance use disorders and prevent opioid overdose.
Effective August 1, 2019.
