SENATE BILL NO. 57

PUBLIC RECORDS.  Provides for certain records management services. (8/1/19)
1	AN ACT
2 To amend and reenact R.S. 44:415, relative to the records management program at the
3 division of archives, records management, and history within the Department of
4 State; to provide for the centralized document conversion center for the state; and to
5 provide for related matters.
6 Be it enacted by the Legislature of Louisiana:
7 Section 1.  R.S. 44:415 is hereby amended and reenacted to read as follows: 
8 ยง415.  Centralized microfilm service imaging and preservation services
9	The microfilm section of the records management program of the division
10 shall be the centralized microfilm center for the state. The imaging and
11 preservation services section of the records management program of the
12 division shall be the centralized document conversion center for the state. All
13 state agencies lacking existing internally established microfilming paper conversion
14 systems of their own, and those state agencies whose equipment or facilities are no
15 longer adequate to meet the agency's need, shall contract with the division for
16 microfilming conversion services or shall obtain division approval for any such a
17 conversion contract with any other vendor or purchase of any other conversion

1 system. All microfilming records produced by state agency microfilming
2 conversion systems shall comply with standards established by the division in
3 accordance with R.S. 44:405(A)(3). This provision shall not be applicable to any
4 state agency where it can be demonstrated to be more economically feasible to
5 continue the microfilming within the agency.

Present law provides that the microfilm section of the records management program of the
division of archives, records management, and history (division) within the Department of
State will be the centralized microfilm center for the state. 
Proposed law provides for the removal of the term microfilming to reflect other document
preservation systems provided by the imaging and preservation services section of the
records management program of the division.
Present law requires all state agencies to obtain division approval for a conversion contract
with any other conversion vendor.
Proposed law retains present law and further requires all state agencies to obtain division
approval for the purchase of any conversion system.
Present law provides that the requirements of present law will not be applicable to any state
agency where it can be demonstrated to be more economically feasible to continue the
microfilming within the agency.
Proposed law removes the exemption.
Effective August 1, 2019.
