Present law provides for the governor to call a special election for the purpose of determining
whether the unincorporated area described in the petition shall become a municipality.
Present law authorizes all qualified electors residing within the area proposed for incorporation to
be entitled to vote in the special election.
Proposed law retains present law but provides for an exception for parishes having a population in
excess of 440,000, based on the latest federal decennial census, authorizing all qualified electors
residing within the parishes of the area proposed for incorporation to be entitled to vote in the special
election to determine whether the unincorporated area shall become a municipality.
Effective August 1, 2019.
