HEALTH/ACC INSURANCE. Authorizes group health insurance providers to consent on
behalf of their employees for use of electronic documents. (8/1/19)
1 AN ACT
2 To enact R.S. 22:2462(E), relative to electronic delivery of insurance documents and
3 notices; to authorize an employer that provides group health insurance to its
4 employees to consent on behalf of its employees for use of electronic documents
5 provided certain requirements are met; and to provide for related matters.
6 Be it enacted by the Legislature of Louisiana:
7 Section 1. R.S. 22:2462(E) is hereby enacted to read as follows:
8 ยง2462. Electronic delivery of insurance documents and notices

10 E.(1) For purposes of this Subsection, an employer policyholder of a
11 group health plan may consent to electronic delivery on behalf of its covered
12 employees.
13 (2) For such consent to be effective for a particular employee, the
14 covered employee must be able to effectively access documents delivered by
15 electronic means at any location that the employee is reasonably expected to
16 perform his job duties and such access must be an integral part of those duties.
17 (3) The covered employee shall also be notified:

1 (a) That he has the right to withdraw such consent at any time.
2 (b) Of the process for withdrawing such consent.
3 (c) That he has the right to request and the process for requesting any
4 such document in paper form.

Present law provides for the electronic delivery of insurance documents and notices by an
insurer to an insured.
Proposed law permits an employer that provides group health insurance to its employees to
consent on behalf of its employees for use of electronic documents provided certain
requirements are met.
