[R.S. 1:13(B) and 24:177(E)] SB 64 Engrossed 2019 Regular Session John Smith Present law authorizes an insurer to deliver, store, or present any notice to a party, or any other document required by law in an insurance transaction or that is to serve as evidence of insurance coverage, by electronic means if those means meet the requirements of the La. Uniform Electronic Transactions Act. Proposed law retains present law and further permits an employer that provides group health insurance to its employees to consent on behalf of a covered employee to the use of electronic documents if the employee is able to effectively access documents delivered by electronic means at any location that the employee is reasonably expected to perform his job duties and the ability to access the documents is an integral part of those duties. Proposed law also requires the employee to be notified of all of the following: (1)The right to withdraw consent at any time. (2)The process for withdrawing consent. (3)The right to request and the process for requesting any document in paper form. Effective August 1, 2019.
