2019 Regular Session ENROLLED SENATE BILL NO. 72 BY SENATOR CARTER 1 AN ACT 2 To amend and reenact Section 2(a) of Act 305 of the 1978 Regular Session of the 3 Legislature as amended by Act No. 572 of the 1984 Regular Session of the 4 Legislature, Act No. 1013 of the 1993 Regular Session of the Legislature, and Act 5 No. 1174 of the 1997 Regular Session of the Legislature or to amend and reenact 6 R.S. 33:4710.12(A)(introductory paragraph) and to enact R.S. 33:4710.12(A)(1)(f), 7 relative to the board of commissioners for the Ernest N. Morial-New Orleans 8 Exhibition Authority; to add an additional member to the board of commissioners; 9 to provide for residency requirements of the member; and to provide for related 10 matters. 11 Notice of intention to introduce this Act has been published. 12 Be it enacted by the Legislature of Louisiana: 13 Section 1. Section 2(a) of Act 305 of the 1978 Regular Session of the Legislature 14 as amended by Act No. 572 of the 1984 Regular Session of the Legislature, Act No. 1013 15 of the 1993 Regular Session of the Legislature, and Act No. 1174 of the 1997 Regular 16 Session of the Legislature is hereby amended and reenacted to read as follows: 17 * * * 18 Section 2.(a). The authority shall be governed by a board of commissioners, 19 hereinafter called the "board", which shall be composed of twelve thirteen appointed 20 members. Three members shall be appointed by the governor. One member shall be 21 appointed by the mayor of the city of New Orleans with the consent of the council 22 of the city of New Orleans. One member shall be appointed by the governor from a 23 list of three names submitted by the New Orleans Restaurant Association. Louisiana 24 Restaurant Association, Greater New Orleans Chapter. SB NO. 72 ENROLLED 1 limits of the authority. One member shall be appointed by the governor from a list 2 of three names submitted by the Greater New Orleans Hotel and Motel Lodging 3 Association. One member shall be appointed by the mayor of the city of New 4 Orleans from a list of three names submitted by the Greater New Orleans Tourist and 5 Convention Commission New Orleans & Company, formerly the New Orleans 6 Convention and Visitors Bureau with the consent of the council of the city of New 7 Orleans. One member shall be appointed by the mayor of the city of New Orleans 8 from a list of three names submitted by the Chamber-New Orleans and the River 9 Region with the consent of the council of the city of New Orleans. One member shall 10 be appointed by the governor who shall be a resident of the legislative district in 11 which the Ernest N. Morial Convention Center is located, and who shall be selected 12 by the state representative and state senator from that district. One member shall be 13 appointed by the governor, who shall reside on the Westbank of Orleans Parish 14 and shall have experience or a background in tourism, hospitality, or business, 15 from a list of three names submitted by the state representative who represents 16 House District No. 102 and the state senator who represents Senate District 17 No. 7. From the names remaining on the list of the various aforesaid organizations, 18 the governor shall select and appoint one of them as a member of the authority and 19 who shall also serve as its president. Except as provided in the Subsection, all 20 persons who are appointed to the board shall be residents of or have their principal 21 place of business in the parish of Orleans. 22 * * * 23 Section 2. R.S. 33:4710.12(A)(introductory paragraph) is hereby amended and 24 reenacted and R.S. 33:4710.12(A)(1)(f) is hereby enacted to read as follows: 25 ยง4710.12. Board of commissioners 26 A. SB NO. 72 ENROLLED 1 (f) One member who resides on the Westbank of Orleans Parish and 2 who has experience or a background in tourism, hospitality, or business, from 3 a list of three names submitted by the state representative who represents House 4 District No. 102 and the state senator who represents Senate District No. 7. 5 * * * 6 Section 3. References to R.S. 33:4710.12(A) in this Act refer to that Subsection as 7 enacted in the Act that originated as House Bill No. 617 of this 2019 Regular Session of the 8 Legislature. 9 Section 4. Sections 1 and 2 of this Act are intended to achieve the same purpose but 10 are drafted differently. Section 1 amends provisions of law as they are presently. Section 11 2 amends provisions of law as they will be if House Bill No. 617 of this 2019 Regular 12 Session of the Legislature becomes law. Only one of the two Sections shall be given effect 13 as follows: 14 (1) If House Bill No. 617 of this 2019 Regular Session of the Legislature becomes 15 law, the provisions of Section 1 of this Act shall not become effective. 16 (2) If House Bill No. 617 of this 2019 Regular Session of the Legislature does not 17 become law, the provisions of Section 2 of this Act shall not become effective. 18 Section 5. Subject to the limitation provided by Section 4 of this Act, this Act shall 19 become effective upon signature by the governor or, if not signed by the governor, upon 20 expiration of the time for bills to become law without signature by the governor, as provided 21 by Article III, Section 18 of the Constitution of Louisiana. If vetoed by the governor and 22 subsequently approved by the legislature, this Act shall become effective on the day 23 following such approval.
