LOCAL AGENCIES.  Provides relative to the board of commissioners of the Iberia Parish
Hospital Service District No. 1. (8/1/19)
1	AN ACT
2 To amend and reenact R.S. 46:1053(B)(4), relative to Iberia Parish Hospital Service District
3 No. 1; to provide for board membership; to provide for term limits; to provide for
4 transition; and to provide for related matters.
5	Notice of intention to introduce this Act has been published.
6 Be it enacted by the Legislature of Louisiana:
7 Section 1.  R.S. 46:1053(B)(4) is hereby amended and reenacted to read as follows: 
8 ยง1053. Commission; qualification of members; appointment; vacancies;
9	compensation; removal of commissioners; certain powers

12	(4)(a) In the parish of Iberia, the Iberia Parish Hospital Service District No.
13 1 shall be governed by a commission composed of nine members who shall be
14 registered voters, residents, and domiciled in the district.  Seven members of the
15 commission shall be appointed by the governing authority of Iberia Parish to
16 serve four-year terms.  The two additional members provided for by this Paragraph
17 shall be appointed by the governing authority of Iberia Parish from applications

1 submitted by the medical staff of the Iberia General Hospital and Medical Center
2 only medical executive committee of Iberia Medical Center to serve four-year
3 terms. The two additional members shall each serve an initial term of four years and
4 their successors shall be appointed for four-year terms. Upon the expiration of the
5 terms of the current board of commissioners in office on August 15, 1995, or in the
6 case of a vacancy on the board of commissioners on or after August 15, 1995, each
7 successor shall be appointed for a four-year term. The medical executive committee
8 shall make any such appointments prior to the expiration of the expiring term
9 or within thirty days after receipt of written notice from the governing
10 authority of Iberia Parish that any such term is about to expire, whichever
11 occurs later.  The medical staff members eligible for service on the Board of
12 Commissioners of Iberia Parish Hospital Service District No. 1 shall be
13 physicians who are fully credentialed and in good standing with the medical
14 executive committee.  The medical executive committee shall use all reasonable
15 means to involve as many of the physician medical staff members as possible in
16 the process of selecting and making such appointments.
17	(b)(i) The terms of the members of the board of commissioners in office on
18 July 1, 2001, shall expire as provided by law. Notwithstanding the provisions of
19 Subparagraph (a) of this Paragraph or any other provision of this Section, the
20 successor of each such member shall be appointed for a term established by the
21 Iberia Parish Council. However, no such term shall exceed four years and the terms
22 of not more than three such successors shall expire in any one year.
23	(ii) Upon the expiration of the terms established by the Iberia Parish Council
24 for the successors appointed as provided in Item (i) of this Subparagraph, each
25 member of the board of commissioners shall serve a four-year term no member of
26 the board of commissioners shall serve more than three consecutive terms. 
27 However, service as a result of appointment or election to fill an unexpired term
28 shall not be considered for such purposes.
29	(iii) Notwithstanding the provisions of Subparagraph (a) of this

1 Paragraph or any other provision of this Section, nothing shall be construed to
2 affect the currently serving members of the board of commissioners of Iberia
3 Parish Hospital Service District No. 1.  However, upon expiration of the term
4 of office of the commission member whose term expires on or about November
5 23, 2019, or the resignation of such member, whichever occurs first, the
6 successor shall be appointed by the medical executive committee of Iberia
7 Medical Center. Upon expiration of the term of office of the physician
8 commission member whose term expires on or about December 27, 2021, or the
9 resignation of such member, the successor shall also be appointed by the
10 medical executive committee of Iberia Medical Center.  These two members
11 shall be designated and recognized as the two commission seats to be filled by
12 appointment of the physician medical staff of Iberia Medical Center. 
13	(c) A vacancy that occurs prior to the expiration of a term shall be filled for
14 the remainder of the unexpired term in the same manner as the predecessor
15 appointee was selected.

Present law provides that any hospital service district formed or created under the provisions
of present law shall be governed by a board of five commissioners who shall be qualified
voters and residents of the district.  Provides that the commissioners shall be appointed by
the police jury of the parish. 
Present law provides an exception for Iberia Parish Hospital Service District No. 1.  Provides
that it shall be governed by a commission of nine members. Provides that two of the
additional members shall be appointed by the governing authority of Iberia Parish from
applications submitted by the medical staff of the Iberia General Hospital and Medical
Center.
Proposed law, regarding Iberia Parish Hospital Service District No. 1, retains present law
nine member board and clarifies that seven members of the board of commissioners shall
be appointed by the Iberia Parish governing authority. 
Proposed law changes present law from two members appointed by the governing authority
from applications submitted by the medical staff to two members appointed by the medical
executive committee of Iberia Medical Center. Requires that the members appointed by the
committee be physicians who are fully credentialed and in good standing with the medical

executive committee. 
Proposed law provides further that no member of the board shall serve more than three
consecutive terms; however, any service as part of another member's unexpired term shall
not be counted.
Proposed law provides for transition for current board members. Also provides that a
vacancy shall be filled in the same manner as the predecessor's appointment. 
Effective August 1, 2019.
