1 AN ACT
2 To amend and reenact R.S. 46:1053(B)(4), relative to Iberia Parish Hospital Service District
3 No. 1; to provide for board membership; to provide for term limits; to provide for
4 transition; and to provide for related matters.

6 Be it enacted by the Legislature of Louisiana:
7 Section 1. R.S. 46:1053(B)(4) is hereby amended and reenacted to read as follows:

12 (4)(a) In the parish of Iberia, the Iberia Parish Hospital Service District No. 1
13 shall be governed by a commission composed of nine members who shall be
14 registered voters, residents, and domiciled in the district. Seven members of the
15 commission shall be appointed by the governing authority of Iberia Parish to
16 serve four-year terms. The two additional members provided for by this Paragraph
17 shall be appointed by the governing authority of Iberia Parish from applications
18 submitted by the medical staff of the Iberia General Hospital and Medical Center
19 only medical executive committee of Iberia Medical Center to serve four-year
20 terms. The two additional members shall each serve an initial term of four years and
21 their successors shall be appointed for four-year terms. Upon the expiration of the
22 terms of the current board of commissioners in office on August 15, 1995, or in the
23 case of a vacancy on the board of commissioners on or after August 15, 1995, each
24 successor shall be appointed for a four-year term. The medical executive committee
25 shall make any such appointments prior to the expiration of the expiring term
26 or within thirty days after receipt of written notice from the governing

1 authority of Iberia Parish that any such term is about to expire, whichever
2 occurs later. The medical staff members eligible for service on the board of
3 commissioners of Iberia Parish Hospital Service District No. 1 shall be
4 physicians who are fully credentialed and in good standing with the medical
5 executive committee. The medical executive committee shall use all reasonable
6 means to involve as many of the physician medical staff members as possible in
7 the process of selecting and making such appointments.
8 (b)(i) The terms of the members of the board of commissioners in office on
9 July 1, 2001, shall expire as provided by law. Notwithstanding the provisions of
10 Subparagraph (a) of this Paragraph or any other provision of this Section, the
11 successor of each such member shall be appointed for a term established by the
12 Iberia Parish Council. However, no such term shall exceed four years and the terms
13 of not more than three such successors shall expire in any one year.
14 (ii) Upon the expiration of the terms established by the Iberia Parish Council
15 for the successors appointed as provided in Item (i) of this Subparagraph, each
16 member of the board of commissioners shall serve a four-year term no member of
17 the board of commissioners shall serve more than three consecutive terms.
18 However, service as a result of appointment or election to fill an unexpired term
19 shall not be considered for such purposes.
20 (iii) Notwithstanding the provisions of Subparagraph (a) of this
21 Paragraph or any other provision of this Section, nothing shall be construed to
22 affect the currently serving members of the board of commissioners of Iberia
23 Parish Hospital Service District No. 1. However, upon expiration of the term
24 of office of the commission member whose term expires on or about November
25 23, 2019, or the resignation of such member, whichever occurs first, the
26 successor shall be appointed by the medical executive committee of Iberia
27 Medical Center. Upon expiration of the term of office of the physician
28 commission member whose term expires on or about December 27, 2021, or the
29 resignation of such member, the successor shall also be appointed by the
30 medical executive committee of Iberia Medical Center. These two members

1 shall be designated and recognized as the two commission seats to be filled by
2 appointment of the physician medical staff of Iberia Medical Center.
3 (c) A vacancy that occurs prior to the expiration of a term shall be filled for
4 the remainder of the unexpired term in the same manner as the predecessor
5 appointee was selected.
