SLS 19RS-1261 ORIGINAL 2019 Regular Session SENATE CONCURRENT RESOL UTION NO. 102 BY SENATOR BARROW CONTRACTORS. Requests the Louisiana State Licensing Board for Contractors to study the criteria used to assess penalties against contractors who violate licensing laws. 1 A CONCURRENT RESOL UTION 2 To urge and request the Louisiana State Licensing Board for Contractors to study the criteria 3 it uses to assess penalties against contractors who violate licensing laws and to 4 submit a written report of its findings to the legislature on or before 5 February 15, 2020. 6 WHEREAS, the Louisiana State Licensing Board for Contractors was created in 7 1965 to protect the public from contractor fraud by maintaining the integrity of the 8 construction industry; and 9 WHEREAS, the compliance division is the investigative and enforcement arm of the 10 board and works to ensure that construction projects are conducted in accordance with the 11 contractor licensing laws of the state; and 12 WHEREAS, the compliance division received 451 complaints in 2018, 394 of which 13 resulted in a fine, two of which resulted in a license suspension or probation, and three of 14 which resulted in a license revocation; and 15 WHEREAS, upon the receipt of a complaint, the board gathers documents and 16 conducts an investigation; and 17 WHEREAS, the contractor alleged to be in violation of state licensing laws is 18 summoned to appear before the board for an administrative hearing; and Page 1 of 2 SCR NO. 102 SLS 19RS-1261 ORIGINAL 1 WHEREAS, it is after this investigation and hearing that the board makes a 2 determination and assesses a penalty if the contractor is found guilty; and 3 WHEREAS, a penalty may range in degree from a fine to license suspension or 4 revocation; and 5 WHEREAS, the penalties currently assessed are not adequately deterring individuals 6 from repeating violations; and 7 WHEREAS, the board is urged to review its penalties and to study the criteria it uses 8 to assess those penalties to ensure that contractors are operating within the confines of the 9 law and that those who violate the law are deterred from doing so again. 10 THEREFORE, BE IT RESOLVED that the Legislature of Louisiana does hereby 11 urge and request the Louisiana State Licensing Board for Contractors to study the criteria 12 used to assess penalties against contractors violating state law and to submit a written report 13 of its findings to the president of the Senate and the speaker of the House of Representatives 14 on or before February 15, 2020. 15 BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to the 16 Louisiana State Licensing Board for Contractors.
