SLS 19RS-323 ENGROSSED 2019 Regular Session SENATE CONCURRENT RESOL UTION NO. 91 BY SENATOR DONAHUE COURTS. Creates a task force to study the advisability of creating a statewide business court. 1 A CONCURRENT RESOL UTION 2 To create and provide with respect to a task force to study and make recommendations with 3 respect to the advisability of creating a statewide business court to lower costs, 4 enhance efficiency, and promote predictable outcomes. 5 WHEREAS, the state of Louisiana has experienced exponential growth in business 6 and industry; and 7 WHEREAS, the legal issues arising in the daily activities of business and industry 8 are often complex, requiring specialized legal knowledge; and 9 WHEREAS, the citizens of the state of Louisiana would benefit from the creation of 10 a statewide business court with jurisdiction over matters which arise in business and 11 industry; and 12 WHEREAS, there are many benefits of creating specialized courts and particularly 13 a business court. 14 THEREFORE, BE IT RESOLVED that the Legislature of Louisiana hereby creates 15 a task force to study and make recommendations to the legislature on the advisability of 16 creating a statewide business court to lower costs, enhance efficiency, and promote 17 predictable outcomes. 18 BE IT FURTHER RESOLVED that the task force shall consist of the following: Page 1 of 3 SCR NO. 91 SLS 19RS-323 ENGROSSED 1 (1) The president of the Senate or his designee. 2 (2) The speaker of the House of Representatives or his designee. 3 (3) The president of the Louisiana State Bar Association. 4 (4) The president of Louisiana Association of Business and Industry or his designee. 5 (5) The president of Council for A Better Louisiana or his designee. 6 (6) The president of Public Affairs Research Council of Louisiana or his designee. 7 (7) The president of Greater New Orleans, Inc. or his designee. 8 (8) The chairman of the Senate Judiciary A Committee or his designee. 9 (9) The chairman of the House Committee on Civil Law and Procedure or his 10 designee. 11 (10) The Chief Justice of the Louisiana Supreme Court or her designee. 12 BE IT FURTHER RESOLVED that the members of the task force shall serve 13 without compensation, except per diem or expense reimbursement to which they may be 14 individually entitled as a member of their respective constituent organization. 15 BE IT FURTHER RESOLVED that the task force may conduct such meetings at 16 such times as it may deem necessary or convenient to enable it to exercise fully and 17 effectively its powers, perform its duties, and accomplish the objectives and purposes of this 18 Resolution. 19 BE IT FURTHER RESOLVED that the task force shall make a report of its findings 20 and recommendations, with a suggestion for proposed legislation, if any, to the president of 21 the Senate and speaker of the House of Representatives by February 1, 2020.
