SENATE RESOLUTION NO. 103

DWI.  Requests the Governor's Task Force on DWI to study issues related to enforcement
actions by a drug recognition expert relative to the operation of a motor vehicle when
impaired by drugs.
1	A RESOLUTION
2 To urge and request the Governor's Task Force on DWI to study issues related to
3 enforcement actions by a drug recognition expert relative to the operation of a motor
4 vehicle when impaired by drugs.
5 WHEREAS, the Governor's Task Force on DWI was reestablished by Executive
6 Order JBE 18-03 to address the high incidence of driving while intoxicated or under the
7 influence of drugs, data collection and analysis on DWI conviction rates, the prevalence of
8 drivers refusing to submit to tests as directed by law enforcement and strategies to reduce
9 such incidences, and the frequency of arrest, prosecution, and conviction of drug-impaired
10 drivers; and
11 WHEREAS, the Governor's Task Force on DWI was reestablished to help identify
12 and implement effective countermeasures and strategies to reduce incidences of driving
13 while intoxicated or under the influence of drugs; and 
14 WHEREAS, use of a drug recognition expert to perform a drug recognition
15 examination may provide another tool to law enforcement; however, performance of a drug
16 recognition examination presents multiple issues related to existing Louisiana laws
17 governing enforcement actions, including the suspension of a driver's license, implied
18 consent, constitutional protections available to the driver, and administrative and judicial

1 review of enforcement actions.
2 THEREFORE, BE IT RESOLVED that the Senate of the Legislature of Louisiana
3 does hereby request the Governor's Task Force on DWI to study issues related to
4 enforcement actions by a drug recognition expert relative to the operation of a motor vehicle
5 when impaired by drugs.
6 BE IT FURTHER RESOLVED that the Governor's Task Force on DWI prepare
7 recommended legislation for presentation at the 2020 Regular Session of the Louisiana
8 Legislature.
9 BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to
10 Chaunda Allen Mitchell, PhD, contact person for the Governor's Task Force on DWI.
