HLS 201ES-22 ORIGINAL 2020 First Extraordinary Session HOUSE CONCURRENT RESOL UTION NO. 7 BY REPRESENTATIVE IVEY LEGISLATIVE AGCY/LAW INST: Directs the Louisiana State Law Institute to study the Constitution of Louisiana and make recommendations to the legislature regarding transitional and outdated language that can be removed or changed without affecting the effect of the constitutional provisions 1 A CONCURRENT RESOL UTION 2To authorize and direct the Louisiana State Law Institute to study and make 3 recommendations to the Legislature of Louisiana regarding language in the 4 Constitution of Louisiana that is outdated or transitional in nature and which can be 5 removed or updated without affecting the effect of the constitutional provisions. 6 WHEREAS, it has been more than forty-five years since the Constitution of 7Louisiana became effective at midnight on December 31, 1974, and during these years the 8document which constitutes the state's basic law has been amended some one hundred 9ninety-seven times; and 10 WHEREAS, the language of the Constitution of Louisiana has not been studied 11broadly since it became effective and the legislature recognizes the importance for legal 12scholars to review the language to determine if there are updates or modifications to the 13language that should be made without changing the meaning and effect of the law. 14 THEREFORE, BE IT RESOLVED that the Legislature of Louisiana does hereby 15authorize and direct the Louisiana State Law Institute to study and make recommendations 16to the Legislature of Louisiana regarding language in the Constitution of Louisiana that is 17outdated or transitional in nature and which can be removed or updated without affecting the 18effect of the constitutional provisions. 19 BE IT FURTHER RESOLVED that the Louisiana State Law Institute should further 20identify language in the constitution that is legally unnecessary, redundant, or obsolete; Page 1 of 2 HLS 201ES-22 ORIGINAL HCR NO. 7 1language that from an organizational or structural perspective should either be placed 2elsewhere in the constitution or should be reworded; and language that either from a best 3practice or comparative perspective is unusual or most commonly located in statute. 4 BE IT FURTHER RESOLVED that the Louisiana State Law Institute shall submit 5its findings and recommendations to each member of the legislature no later than February 61, 2022. 7 BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to the 8director of the Louisiana State Law Institute.
