HOUSE RESOLUTION NO. 16
BY REPRESENTATIVE VILLIO
MEDICAID:  Directs the Louisiana Department of Health to compile certain data regarding
the implementation of a Medicaid managed long-term supports and services system
1	A RESOLUTION
2To authorize and direct the Louisiana Department of Health to compile certain data that will
3 indicate the programmatic and fiscal impact of implementing a Medicaid managed
4 long-term supports and services system and report its findings to the House of
5 Representatives of the Legislature of Louisiana.
6 WHEREAS, several states utilize a Medicaid managed long-term supports and
7services system as a strategy for improving access to home- and community-based services,
8promoting community inclusion, ensuring quality, and increasing efficiency and fiscal
9sustainability of their Medicaid programs; and
10 WHEREAS, senior citizens represent the largest population who receive Medicaid
11long-term care supports and services and Louisiana would best serve its senior citizens by
12implementing programs that have an emphasis on choice, consumer-driven care, and
13services that actively promote community-based alternatives; and
14 WHEREAS, those persons receiving Medicaid managed long-term supports and
15services are the only beneficiary group currently excluded from Medicaid managed care
16which leaves those persons ineligible for new types of services that could better integrate
17care, management, promote independence, employment, wellness, and recovery, or may
18detect and delay the increased risks associated with chronic diseases; and

1 WHEREAS, previously, the Louisiana Department of Health developed a plan for
2implementing a Medicaid managed long-term supports and services system which showed
3the potential to generate additional federal matching funds and slow growth in Medicaid
4spending for long-term supports and services; and
5 WHEREAS, in order to make informed decisions about the merits of a Medicaid
6managed long-term supports and services system, it is imperative that the Legislature of
7Louisiana have accurate data and information.
8 THEREFORE, BE IT RESOLVED that the House of Representatives of the
9Legislature of Louisiana does hereby direct the Louisiana Department of Health to compile
10certain data that will indicate the programmatic and fiscal impact regarding the
11implementation of a Medicaid managed long-term supports and services system.
12 BE IT FURTHER RESOLVED that in preparing and compiling such data, the
13Louisiana Department of Health shall consider the following assumptions that:
14 (1)  Managed long-term supports and services shall apply to Medicaid recipients who
15may be elderly or have adult-onset disabilities and who meet the eligibility requirements for
16receiving managed long-term supports and services through a Medicaid state plan or waiver
17program that is designed for the population, including but not limited to nursing facilities,
18home- and community-based waivers, state plan personal care programs, or to those
19recipients who are dual-eligible and are not otherwise receiving managed long-term supports
20and services.
21 (2)  Managed long-term supports and services shall not apply to Medicaid recipients
22who are eligible for and receive services due to an intellectual or developmental disability.
23 (3)  Managed long-term supports and services shall include the guidance that has
24been set forth by the Centers for Medicare and Medicaid Services to the states as minimum
25components that will increase the likelihood of a high-quality managed long-term supports
26and services program.
27 (4)  Managed long-term supports and services shall cover provisions of all Medicaid
28physical, behavioral, pharmacy, facility-based, and community-based healthcare supports
29and services.

1 (5)  Managed long-term supports and services shall establish a provider
2reimbursement floor rate at the Medicaid fee-for-service rate.
3 (6)  The office of aging and adult services of the Louisiana Department of Health
4shall retain authority for determining recipient eligibility for Medicaid-funded long-term
5supports and services for the population covered, including all initial assessments and
6recertifications.
7 (7)  Managed long-term supports and services would be implemented at the
8beginning of the next state fiscal year, July 1, 2021.
9 BE IT FURTHER RESOLVED that the Louisiana Department of Health shall
10prepare and compile certain data to include all fiscal impacts including but not limited to
11projected changes in utilization, inclusion of all current revenue sources, inclusion of any
12additional revenue sources resulting from implementing a managed long-term supports and
13services program, such as increased managed care premium tax collections, inclusion of any
14increase in federal match resulting from the use of any additional revenue, and transition
15costs based solely on the population including any administrative savings or costs resulting
16from implementing managed long-term supports and services.
17 BE IT FURTHER RESOLVED that the Louisiana Department of Health shall
18prepare and compile certain data that may provide for a planning and preparation phase not
19to exceed two years and shall prepare data for a three-year period following the
20implementation of a managed long-term supports and services system.
21 BE IT FURTHER RESOLVED that the Louisiana Department of Health may assume
22that the provision of acute, behavioral, and other Medicaid services is provided to other
23Medicaid recipients through managed care and will operate in the same manner other than
24being a part of the Medicaid managed long-term supports and services system.
25 BE IT FURTHER RESOLVED that if there is any uncertainty about the parameters
26of the managed long-term supports and services system, the Louisiana Department of Health
27shall follow the provisions of the request for proposals for managed long-term supports and
28services prepared and approved for release by the division of administration in April of 2016
29and the Medicaid waiver documents prepared in association with such request.

1 BE IT FURTHER RESOLVED that the Louisiana Department of Health shall submit
2a report of its findings and outcomes to the House of Representatives of the Legislature of
3Louisiana and to the David R. Poynter Legislative Research Library no later than February
41, 2021.
5 BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to the
6secretary of the Louisiana Department of Health.
