SLS 201ES-183 ORIGINAL 2020 First Extraordinary Session SENATE CONCURRENT RESOL UTION NO. 16 BY SENATOR ROBERT MILLS COURTS. Suspends certain provisions of law relative to the jury trial threshold. (Item #40) 1 A CONCURRENT RESOL UTION 2 To suspend until sixty days after final adjournment of the 2021 Regular Session of the 3 Legislature of Louisiana the Code of Civil Procedure Article 1732(A)(1) relative to 4 the jury trial threshold for a petitioner's cause of action. 5 WHEREAS, Article III, Section 20 of the Constitution of Louisiana provides that 6 only the legislature may suspend a law; and 7 WHEREAS, Code of Civil Procedure Article 1732(A)(1) provides that a jury trial 8 is not available in suits where no individual petitioner's cause of action exceeds fifty 9 thousand dollars exclusive of interest and costs; and 10 WHEREAS, substantial revisions to Code of Civil Procedure Article 1732(A)(1) are 11 required in order to achieve the goals of the Legislature of Louisiana concerning tort reform 12 and lowering of motor vehicle insurance premiums; and 13 WHEREAS, the purpose of this Resolution is to allow the Legislature of Louisiana 14 additional opportunity to make necessary revisions to Code of Civil Procedure Article 15 1732(A)(1). 16 THEREFORE, BE IT RESOLVED that the Legislature of Louisiana hereby suspends 17 the provisions of Code of Civil Procedure Article 1732(A)(1). 18 BE IT FURTHER RESOLVED that this suspension shall become effective upon Page 1 of 2 SCR NO. 16 SLS 201ES-183 ORIGINAL 1 adoption of this Resolution and shall extend through the sixtieth day after final adjournment 2 of the 2021 Regular Session of the Legislature of Louisiana.
