SLS 201ES-74 ORIGINAL 2020 First Extraordinary Session SENATE CONCURRENT RESOL UTION NO. 7 BY SENATOR FIELDS LEGIS POWERS/FUNCTIONS. Establishes the Police Training, Screening, and De-esclation Task Force to study and make recommendations to the legislature. 1 A CONCURRENT RESOL UTION 2 To establish the Police Training, Screening, and De-escalation Task Force to study and 3 make recommendations to the legislature. 4 WHEREAS, the recent killing of George Floyd in Minnesota, and a series of other 5 similar acts, has focused public discourse on the causes of police brutality and the use of 6 excessive force, especially when used against people of color; and 7 WHEREAS, according to a 2016 study published by the American Journal of Health, 8 black men are three times more likely than white men to be killed by police intervention; and 9 WHEREAS, in order to propose legislation to address the disparate treatment of 10 people of color by law enforcement agencies, a task force composed of legislative, 11 administrative, law enforcement, academic, and racial justice leaders must be created. 12 THEREFORE, BE IT RESOLVED that the Legislature of Louisiana does hereby 13 create a Police Training, Screening, and De-escalation Task Force to study and make 14 recommendations to the legislature on the topics, among others, of training, screening, 15 de-escalation, racial bias recognition, misconduct, duty to report misconduct, penalties, use 16 of force, identifying and eliminating bad actors, and any other recommendations the task 17 force deems necessary to restore the public's trust that the law enforcement community is 18 serving and protecting all the citizens of Louisiana in a fair and unbiased manner. Page 1 of 4 SCR NO. 7 SLS 201ES-74 ORIGINAL 1 BE IT FURTHER RESOLVED that the task force shall be comprised of the 2 following members: 3 (1) The president of the Louisiana Senate, or his designee who shall be a member of 4 the Louisiana Senate. 5 (2) The speaker of the Louisiana House of Representatives, or his designee who shall 6 be a member of the Louisiana House of Representatives. 7 (3) The chairman of the Senate Committee on Judiciary B, or his designee who shall 8 be a member of the committee. 9 (4) The chairman of the Senate Committee on Judiciary C, or his designee who shall 10 be a member of the committee. 11 (5) The chairman of the House Committee on Administration of Criminal Justice, or 12 his designee who shall be a member of the committee. 13 (6) The chairman of the House Committee on Judiciary, or his designee who shall 14 be a member of the committee. 15 (7) The attorney general, or his designee who shall be an employee of the 16 Department of Justice. 17 (8) The executive director of the Louisiana Commission on Law Enforcement, or his 18 designee. 19 (9) One peace officer appointed by the governor from a list of four names jointly 20 submitted by the presidents of the Louisiana Fraternal Order of Police and the Louisiana 21 Union of Police Association. 22 (10) One member of the National Association for the Advancement of Colored 23 People Louisiana State Conference appointed by its president. 24 (11) One member of the Urban League of Louisiana appointed by its president. 25 (12) One member of the Louisiana Association of Criminal Defense Attorneys 26 appointed by its president. 27 (13) One law school professor appointed by the governor from a list of four names 28 jointly submitted by the dean of the LSU Paul M. Hebert Law Center, the chancellor of the 29 Southern University Law Center, the dean of the Tulane University Law School, and the 30 dean of the Loyola University New Orleans College of Law. Page 2 of 4 SCR NO. 7 SLS 201ES-74 ORIGINAL 1 (14) One professor of criminal law selected by the president of the Southern 2 University system. 3 (15) One professor of social work selected by the president of the Louisiana State 4 University system. 5 BE IT FURTHER RESOLVED that a majority of the total membership shall 6 constitute a quorum of the task force and that any official action by the task force shall 7 require an affirmative vote of a majority of the quorum present and voting. 8 BE IT FURTHER RESOLVED that the initial meeting of the task force shall be 9 called by the president of the Louisiana Senate. At the first meeting, the task force shall elect 10 a chair. The first meeting shall take place no later than August 15, 2020. The Louisiana 11 Senate shall provide staff support. 12 BE IT FURTHER RESOLVED that members of this task force shall serve without 13 compensation, except per diem or expense reimbursement to which they may be individually 14 entitled as members of the constituent organizations. 15 BE IT FURTHER RESOLVED that the meetings of the task force shall take place 16 at the Louisiana State Capitol, or upon a majority vote of the members such meetings may 17 be conducted by video conference where circumstances necessitate meeting in that manner. 18 BE IT FURTHER RESOLVED that the task force shall meet as necessary and shall 19 report its findings to the legislature not later than February 1, 2021, and shall terminate upon 20 the date of such report or February 1, 2021, whichever occurs first. 21 BE IT FURTHER RESOLVED that a copy of this Resolution be transmitted to the 22 governor, the attorney general, the executive director of the Louisiana Commission on Law 23 Enforcement, the president of the Louisiana Fraternal Order of Police, the president of the 24 Louisiana Union of Police Association, the president of the National Association for the 25 Advancement of Colored People Louisiana State Conference, the president of the Urban 26 League of Louisiana, the president of the Louisiana Association of Criminal Defense 27 Attorneys, the dean of the LSU Paul M. Hebert Law Center, the chancellor of the Southern 28 University Law Center, the dean of the Tulane University Law School, the dean of the 29 Loyola University New Orleans College of Law, the president of the Southern University 30 system, and the president of the Louisiana State University system.
