HLS 202ES-688 ORIGINAL 2020 Second Extraordinary Session HOUSE RESOLUTION NO. 48 BY REPRESENTATIVES GARY CARTER, BUTLER, DAVIS, DESHOTEL, DUPLESSIS, KERNER, AND WILLARD PROCUREMENT: Urges and requests the governor to modify small purchase procedures through an executive order 1 A RESOLUTION 2To urge and request the governor to issue an executive order in accordance with R.S. 3 39:1596 to provide greater opportunities for small, local, and diverse businesses to 4 compete for the state's small purchase procurement needs. 5 WHEREAS, the Louisiana Procurement Code authorizes the governor to establish 6procedures for the procurement of small purchases; and 7 WHEREAS, the legislature created the Louisiana Initiative for Small 8Entrepreneurships, also known as the Hudson Initiative, and the Louisiana Initiative for 9Veteran and Service-Connected Disabled Veteran-Owned Small Entrepreneurships, also 10known as the Veteran Initiative, to facilitate the growth and stability of Louisiana's economy 11by fostering utilization by state interests of the business offerings available for state 12procurement and public contracts from Louisiana's small entrepreneurships and veteran and 13service-connected disabled veteran-owned small entrepreneurships; and 14 WHEREAS, given the magnitude of the state's procurement and public contracting 15activity, state government is uniquely situated to create an environment where small 16entrepreneurships have an opportunity to thrive and ultimately enhance the stability of 17Louisiana's economy; and 18 WHEREAS, the governor issued Executive Order Number JBE 2017-18, relative to 19small purchase procedures, that included waivers for the requirement that agencies solicit 20a certain number of quotations if making purchases from a business certified in accordance 21with the Hudson Initiative and the Veteran Initiative; and Page 1 of 2 HLS 202ES-688 ORIGINAL HR NO. 48 1 WHEREAS, increasing the maximum amount of small purchases that qualify for this 2waiver would improve competitiveness for small, rural, minority, female, and veteran 3enterprises that wish to conduct business with the state. 4 THEREFORE, BE IT RESOLVED that the House of Representatives of the 5Legislature of Louisiana does hereby urge and request the governor to issue an executive 6order in accordance with R.S. 39:1596 to provide greater opportunities for small, local, and 7diverse businesses to compete for the state's small purchase procurement needs. 8 BE IT FURTHER RESOLVED that the House of Representatives of the Legislature 9of Louisiana further requests that the executive order contain the following changes to 10Executive Order Number JBE 2017-18: 11 (1) An increase in the defined maximum value of "small purchases" from twenty- 12five thousand dollars to thirty thousand dollars. 13 (2) An increase in the micro-purchase threshold from five thousand dollars to ten 14thousand dollars. 15 (3) An increase in the intermediate tier from fifteen thousand dollars to twenty 16thousand dollars. 17 (4) An increase in the exemption for purchases made from Hudson and Veterans 18Initiative-certified entrepreneurships from fifteen thousand to thirty thousand. 19 BE IT FURTHER RESOLVED that a suitable copy of this Resolution be transmitted 20to the governor.
