ACT 2 (HB 11) 2020 Regular Session	Carpenter
Existing law provides for the payment of retirement benefits to survivors of Firefighters'
Retirement System members who die prior to beginning to receive retirement benefits.
Prior law provided that in both of the following cases the beneficiary designated by the
member would receive the benefits if the member died prior to beginning to receive
retirement benefits.  New law provides that in both of the following cases, if the member has
a surviving eligible spouse, the spouse shall receive the benefits:
(1)A member who has enough service credit to retire, who leaves employment covered
by the system prior to reaching retirement age, and who has not selected a retirement
option.
(2)A member who is a contributing member and who is eligible to retire but has not
retired.
New law provides that if the member does not have a surviving eligible spouse, the
designated beneficiary shall receive the retirement benefits.
Existing law defines "surviving eligible spouse" as the spouse who was married to and living
with the member at the time of his death.
Effective Aug. 1, 2020.
