RETIREMENT/FIREFIGHTERS: Provides relative to the suspension of benefits of
members of the Firefighters' Retirement System upon reemployment
1 AN ACT
2To amend and reenact R.S. 11:2256(A)(5), relative to the Firefighters' Retirement System;
3 to provide with respect to the reemployment of retirees; to provide for suspension of
4 benefits; and to provide for related matters.
5 Notice of intention to introduce this Act has been published
6 as provided by Article X, Section 29(C) of the Constitution
7 of Louisiana.
8Be it enacted by the Legislature of Louisiana:
9 Section 1. R.S. 11:2256(A)(5) is hereby amended and reenacted to read as follows:

13 (5) Upon returning to work as a full-time employee covered by this system,
14 retirement benefits shall cease and the The benefits of any retiree of this system who
15 returns to employment with an employer covered by this system shall be suspended
16 for the duration of such employment. For full-time employees only, the employee
17 and employer shall contribute to the system towards creditable service. The member
18 may not change the option which was selected under the first retirement
19 computation.

1 Section 2. This Act shall become effective upon signature by the governor or, if not
2signed by the governor, upon expiration of the time for bills to become law without signature
3by the governor, as provided in Article III, Section 18 of the Constitution of Louisiana. If
4vetoed by the governor and subsequently approved by the legislature, this Act shall become
5effective on the day following such approval.

Abstract: Suspends the benefits of any member of the Firefighters' Retirement System
(FRS) who returns to work with an employer covered by the system.
Present law provides that if a retiree from FRS returns to work in a full-time position
covered by the system, payment of his retirement benefits ceases. Proposed law makes the
requirement for cessation of benefits applicable to an FRS retiree who returns to work in a
part-time position covered by the system.
Present law provides that the employee and employer contribute to the system during full-
time reemployment and that the retirement option that was selected at the first retirement
cannot be changed. Proposed law retains present law applicable only to retirees who return
to work in full-time positions.
Effective upon signature of governor or lapse of time for gubernatorial action.
