R.S. 11:2256(A)(5) is hereby amended and reenacted to read as follows: 10 ยง2256. This Act shall become effective upon signature by the governor or, if not 2signed by the governor, upon expiration of the time for bills to become law without signature 3by the governor, as provided in Article III, Section 18 of the Constitution of Louisiana. If 4vetoed by the governor and subsequently approved by the legislature, this Act shall become 5effective on the day following such approval. [R.S. 1:13(B) and 24:177(E)] HB 12 Original 2020 Regular Session Carpenter Abstract: Suspends the benefits of any member of the Firefighters' Retirement System (FRS) who returns to work with an employer covered by the system. Present law provides that if a retiree from FRS returns to work in a full-time position covered by the system, payment of his retirement benefits ceases. Proposed law makes the requirement for cessation of benefits applicable to an FRS retiree who returns to work in a part-time position covered by the system. Present law provides that the employee and employer contribute to the system during full- time reemployment and that the retirement option that was selected at the first retirement cannot be changed. Proposed law retains present law applicable only to retirees who return to work in full-time positions. Effective upon signature of governor or lapse of time for gubernatorial action.
