R.S. 11:2256(A)(5) is hereby amended and reenacted to read as follows: 10 ยง2256. Benefits; refund of contributions, application, and payment 11 A. 12 * * * 13 (5)(a) Upon returning to work as a full-time employee for an employer 14 covered by this system, retirement benefits shall cease and the employee and 15 employer shall contribute to the system towards creditable service. This Act shall become effective upon signature by the governor or, if not 5signed by the governor, upon expiration of the time for bills to become law without signature 6by the governor, as provided in Article III, Section 18 of the Constitution of Louisiana. If 7vetoed by the governor and subsequently approved by the legislature, this Act shall become 8effective on the day following such approval. Present law provides that if a retiree from FRS returns to work in a full-time position covered by the system, payment of his retirement benefits ceases. Proposed law removes the requirement for cessation of benefits applicable to an FRS retiree who returns to work in a part-time position covered by the system. Present law provides that the employee and employer contribute to the system during full- time reemployment and that the retirement option that was selected at the first retirement cannot be changed. Proposed law retains present law and further requires that the employee and employer contribute to the system during any part-time employment, but exclude part- time retirees from accruing credible service during his reemployment. Effective upon signature of governor or lapse of time for gubernatorial action. (Amends R.S. 11:2256(A)(5)) Summary of Amendments Adopted by House The House Floor Amendments to the engrossed bill: 1.
