HOUSE BILL NO. 16

RETIREMENT/STATE EMPS:  Provides relative to the selection of certain optional
survivor benefits for members of the Louisiana State Employees' Retirement System
1	AN ACT
2To amend and reenact R.S. 11:446(A)(introductory paragraph) and (2)(b), relative to
3 Louisiana State Employees' Retirement System benefit options; to provide relative
4 to the selection of such options; and to provide for related matters.
5	Notice of intention to introduce this Act has been published
6	as provided by Article X, Section 29(C) of the Constitution
7	of Louisiana.
8Be it enacted by the Legislature of Louisiana:
9 Section 1.  R.S. 11:446(A)(introductory paragraph) and (2)(b) are hereby amended
10and reenacted to read as follows:
11 ยง446.  Mode of payment where option elected
12	A.  Upon application for retirement and as otherwise provided by
13 Subparagraph (2)(b) of this Subsection, any member may elect to receive his benefit
14 in a retirement allowance payable throughout his life, or he may elect at that time to
15 receive the actuarial equivalent of his retirement allowance in a reduced retirement
16 allowance payable throughout life, with the provision that:

1	(b)  Option 2-B(i).  Upon his death his reduced retirement allowance shall be
2 continued throughout the life of and paid to the person he nominated by written
3 designation and, upon the death of that designated person, his the reduced benefit
4 shall be continued throughout the life of the deceased member's mentally
5 handicapped child or children, but such benefits shall be paid to the guardian of such
6 child or children except as provided in Subsection G of this Section.  The written
7 designation provided for in this Subparagraph shall be duly acknowledged and filed
8 with the board of trustees at the time of the member's retirement.
9	(ii)  A member may elect at any time prior to application for retirement to
10 receive his benefit under this Subparagraph and, notwithstanding Subsection C of
11 this Section, may change his selection if his mentally handicapped child predeceases
12 him.

14 Section 2.  The cost of this Act, if any, shall be funded with additional employer
15contributions in compliance with Article X, Section 29(F) of the Constitution of Louisiana.

Abstract: Allows members of the La. State Employees' Retirement System (LASERS) to
select an optional survivor benefit, for the benefit of a mentally handicapped child,
at any time prior to application for retirement.
Present law provides members of LASERS with various options to receive the actuarial
equivalent of their retirement allowance in a reduced retirement allowance payable
throughout the life of a surviving beneficiary.  A member may select an option only upon
application for retirement, and such selection is irrevocable.
Present law options include Option 2-B which provides that a member's reduced retirement
continues throughout the life of the person he nominated by written designation and, upon
the death of that designated person, the reduced benefit continues throughout the life of his
mentally handicapped child or children.
Proposed law authorizes a member of LASERS to select Option 2-B at any time during his
membership and allows a member to change such selection if his mentally handicapped child
predeceases him.
