WATER/RESOURCES:  Extends cooperative endeavor agreements for use of surface
waters
1	AN ACT
2To amend and reenact R.S. 30:961(E), relative to cooperative endeavor agreements for the
3 withdrawal of surface water; to extend the time for entering cooperative endeavor
4 agreements for withdrawal of surface water; to provide for terms, conditions, and
5 requirements; and to provide for related matters.
6Be it enacted by the Legislature of Louisiana:
7 Section 1.  R.S. 30:961(E) is hereby amended and reenacted to read as follows: 
8 ยง961.  Cooperative endeavor agreements; withdrawal of surface water; intent

10	E.(1)  A cooperative endeavor agreement to withdraw running surface water,
11 or an assignment of such, entered into pursuant to the provisions of this Chapter shall
12 have an initial term not to exceed two years.  No new cooperative endeavor
13 agreement shall be entered into for which an application was received by the
14 department after December 31, 2020; however, except as otherwise provided in this
15 Subsection, existing Existing agreements may be renewed in two-year increments
16 but shall terminate no later than December 31, 2028.
17	(2)  A person or entity who has entered into a cooperative endeavor
18 agreement to withdraw running surface waters or has obtained an assignment of
19 such, may terminate such agreement after December 31, 2020 2022.  In order to be

1 effective, the person or entity seeking to terminate shall provide written notice by
2 certified mail to the secretary at least thirty days prior to termination.

Abstract:  Extends the time a cooperative endeavor agreement for use of the state's surface
water may be entered.
Present law allows a person or entity to enter into a cooperative endeavor agreement to
withdraw running surface water.
Present law requires that a cooperative endeavor agreement to withdraw running surface
water have an initial term not to exceed two years. Further requires that no new cooperative
endeavor agreement can be entered into for which an application was received by the Dept.
of Natural Resources after Dec. 31, 2020.
Proposed law removes the present law provision that prohibits any new cooperative
endeavor agreement after Dec. 31, 2020.
Present law authorizes renewal of agreements in two-year increments but specifies that such
agreements can terminate no later than Dec. 31, 2028.
Proposed law removes the Dec. 31, 2028 termination date applicable to the two-year
renewals of existing agreements.
