ATTORNEYS:  (Constitutional Amendment)  Provides relative to removal of supreme court
jurisdiction over attorney advertisements
1	A JOINT RESOLUTION
2Proposing to amend  Article V, Section 5(B) of the Constitution of Louisiana,  relative to the
3 supreme court's exclusive jurisdiction over members of the bar; to provide for the
4 removal of supreme court jurisdiction over attorney advertisements; to allow
5 attorney advertisements to be regulated and subject to change by law; to provide for
6 submission of the proposed amendment to the electors; and to provide for related
7 matters.
8 Section 1.  Be it resolved by the Legislature of Louisiana, two-thirds of the members
9elected to each house concurring, that there shall be submitted to the electors of the state of
10Louisiana, for their approval or rejection in the manner provided by law, a proposal to
11amend Article V, Section 5(B) of the Constitution of Louisiana, to read as follows:
12 §5.  Supreme Court; Jurisdiction; Rule-Making Power; Assignment of Judges

14	(B)  Original Jurisdiction.  The supreme court has exclusive original
15 jurisdiction of disciplinary proceedings against a member of the bar, except with
16 regard to advertising.  Advertisements by a member of the bar shall be regulated and
17 subject to change by law effective January 1, 2023.

1 Section 2.  Be it further resolved that this proposed amendment shall be submitted
2to the electors of the state of Louisiana at the statewide election to be held on November 3,
32020.
4 Section 3.  Be it further resolved that on the official ballot to be used at the election,
5there shall be printed a proposition, upon which the electors of the state shall be permitted
6to vote YES or NO, to amend the Constitution of Louisiana, which proposition shall read as
7follows:
8	Do you support an amendment to have attorney advertisements regulated and
9	subject to change by law, effective January 1, 2023? (Amends Article V,
10	Section 5(B))

Abstract:  Allows attorney advertisements to be regulated and subject to change by law
effective Jan. 1, 2023.
Present constitution provides that the supreme court has exclusive jurisdiction over members
of the bar.
Proposed constitutional amendment retains present constitution with the exception that
advertising by members of the bar would be regulated and subject to change by law effective
Jan. 1, 2023.
Provides for submission of the proposed amendment to the voters at the statewide election
to be held Nov. 3, 2020.
