R.S. 40:2869(A)(16) is hereby amended and reenacted to read as follows: 7 ยง2869. Pharmacy benefit manager monitoring advisory council; membership; 8 functions 9 A. There is hereby created a pharmacy benefit manager monitoring advisory 10 council, referred to hereafter in this Chapter as the "advisory council", that shall 11 consist of the following members, each of whom may appoint a designee: 12 * * * 13 (16) The president of a pharmacy benefit manager licensed by the Louisiana 14 Board of Pharmacy, selected by the Louisiana affiliate of the Pharmaceutical Care 15 Management Association from a list of interested and qualified individuals. 16 * * * 17 Section 2. This Act shall become effective upon signature by the governor or, if not 18signed by the governor, upon expiration of the time for bills to become law without signature 19by the governor, as provided by Article III, Section 18 of the Constitution of Louisiana. Present law creates the pharmacy benefit manager monitoring advisory council to provide monitoring of pharmacy benefit managers in La. to advise the legislature, commissioner of insurance, and Board of Pharmacy on the most effective and efficient manner of regulation of pharmacy benefit managers to ensure the protection of the public. Proposed law retains present law. Present law provides for 20 members of the advisory council including the president of a pharmacy benefit manager licensed by the Board of Pharmacy, selected by the La. affiliate of the Pharmaceutical Care Management Association from a list of interested and qualified individuals. Proposed law changes the qualification of the member to the president of the Pharmaceutical Care Management Association. Effective upon signature of governor or lapse of time for gubernatorial action.
